<reference>New Act</reference><aliasreference></aliasreference><SynopsisText>Creates the Mercury Thermostat Collection Act. Requires thermostat manufacturers to establish an out-of-service mercury thermostat collection program that meets certain requirements. Requires thermostat manufacturers to submit certain reports on their collection programs to the Agency. Sets goals for the collection of out-of-service mercury thermostats. Provides that if those goals are not met, then the manufacturers must revise their collection programs as necessary to achieve the applicable goal. Requires contractors, service technicians, thermostat wholesalers, thermostat manufacturers, and thermostat retailers to handle and manage out-of-service mercury thermostats in a manner that is consistent with the provisions of the universal waste regulations adopted by the Illinois Pollution Control Board. On and after January 1, 2011, prohibits (i) thermostat wholesalers from selling, offering to sell, distributing, or offering to distribute thermostats unless certain requirements are met and (ii) contractors from removing, replacing, or otherwise taking mercury thermostats out of service unless the contractors deliver those thermostats to a collection site. On and after January 1, 2011, prohibits thermostat manufacturers that are in violation of the Act from selling, offering to sell, distributing, or offering to distribute thermostats in the State. Requires the Agency to post certain information on its website and to report certain information to the General Assembly. Provides for prosecution by the Attorney General or the State's Attorney of the county in which a violation occurs. Requires the Agency to make certain recommendations to the Governor and General Assembly by January 1, 2012. <SynopsisText>Deletes everything after the enacting clause. Creates the Mercury Thermostat Collection Act. Requires each thermostat manufacturer, individually or collectively with other thermostat manufacturers, to establish and maintain a program for the collection and proper management of out-of-service mercury thermostats and to perform other specified duties. Requires manufacturers to report certain information to the Illinois Environmental Protection Agency. Provides for the setting of statewide goals for the collection of mercury thermostats taken out of service in the State. Provides for appellate court review of certain collection goals. Authorizes the Agency to reduce, beginning in calendar year 2018, the statewide goals if it, in consultation with mercury thermostat manufacturers, thermostat wholesalers, contractors, environmental organizations, and other stakeholders, determines that mercury thermostats no longer pose a threat to the environment and public health in Illinois. Provides that if the statewide goals are not met by the manufacturers, then the manufacturers must provide a specified financial incentive. Requires contractors, thermostat wholesalers, thermostat manufacturers, and thermostat retailers participating in the program to handle and manage out-of-service mercury thermostats in a manner that is consistent with the provisions of the Illinois Pollution Control Board rules regarding the disposal of universal waste. Prohibits, on and after July 1, 2011, a thermostat wholesaler from selling, offering to sell, distributing, or offering to distribute thermostats unless the wholesaler takes certain specified actions. Requires the Agency to provide certain types of educational outreach efforts and to distribute certain information. Specifies civil penalties and provides for their collection. Prohibits, beginning July 1, 2011, the mixing of out-of-service mercury thermostats with municipal waste that is intended for disposal at a sanitary landfill and the disposal of out-of-service mercury thermostats in sanitary landfills. Provides for the repeal of the Act on January 1, 2021. Defines "Agency", "Board", "collection program", "contractor", "mercury thermostat", "out-of-service mercury thermostat", "person", "qualified contractor", "qualified local government authorities", "thermostat manufacturer", "thermostat retailer", and "thermostat wholesaler".
