<reference>New Act</reference><aliasreference></aliasreference><SynopsisText>Creates the STAR Bonds Financing Act. Contains only a short title provision.</SynopsisText><synopsistitle>Senate Floor Amendment No. 1</synopsistitle>
<reftype>Adds reference to:</reftype><reference>65 ILCS 5/8-4-1</reference><aliasreference>from Ch. 24, par. 8-4-1</aliasreference><SynopsisText>Deletes everything after the enacting clause. Creates the STAR Bonds Financing Act. Authorizes certain municipalities and counties to issue sales tax and revenue (STAR) bonds for the financing of a STAR bond project. Defines "STAR bond project". Grants certain powers to municipalities and counties, including the power to exercise the use of eminent domain and the power to issue bonds. Specifies eligibility requirements for STAR bond projects. Makes other changes. Amends the Illinois Municipal Code. Provides that the corporate authorities of a municipality may authorize the issuance of STAR bonds without submitting the question of issuing the bonds to the electors of the municipality. Effective immediately.</SynopsisText><synopsistitle>State Debt Impact Note (Government Forecasting & Accountability)</synopsistitle>
<SynopsisText>SB 1909, as engrossed, would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness. </SynopsisText><synopsistitle>Home Rule Note (Dept. of Commerce & Economic Opportunity)</synopsistitle>
<SynopsisText>SB 1909 does not pre-empt home rule authority.</SynopsisText><synopsistitle>State Mandates Fiscal Note (Dept. of Commerce & Economic Opportunity)</synopsistitle>
<SynopsisText>SB 1909 does not create a State mandate.</SynopsisText><synopsistitle>Housing Affordability Impact Note (Housing Development Authority)</synopsistitle>
<SynopsisText>This bill will have no effect on the cost of constructing, purchasing, owning, or selling a single-family residence. </SynopsisText><synopsistitle>Fiscal Note (Dept. of Revenue)</synopsistitle>
<SynopsisText>SB 1909, as engrossed, would have a negative impact on State government revenue from the Retailers' Occupation Tax, Use Tax, Service Occupation Tax, Electricity Excise Tax, Gas Revenue Tax, and Hotel Operators' Occupation Tax. The combined annual loss to these revenue sources could exceed $15 million annually per established district given the terms of the proposal and depending on the location of the district. Much of this loss will be due to the erosion of the State government tax base that existed before the STAR district was created.</SynopsisText><synopsistitle>Balanced Budget Note (Office of Management and Budget)</synopsistitle>
<SynopsisText>SB 1909, as engrossed, would cost the State $15,000,000 in lost sales tax revenue as estimated by the Department of Revenue. SB 1909, if enacted into law would add $15,000,000 in additional spending pressure to the General Revenue Fund and to the current Fiscal Year 2009 budget deficit.</SynopsisText><synopsistitle>Judicial Note, House Floor Amendment No. 2 (Admin Office of the Illinois Courts)</synopsistitle>
<SynopsisText>Based on a review of the bill, it has been determined that SB 1909 (H-AM 2) would neither increase nor decrease the number of judges needed in the State. </SynopsisText><synopsistitle>Correctional Note, House Floor Amendment No. 2 (Dept of Corrections)</synopsistitle>
<SynopsisText>This legislation has no population or fiscal impact on the Department of Corrections. </SynopsisText><synopsistitle>Pension Note, House Floor Amendment No. 2 (Government Forecasting & Accountability)</synopsistitle>
<SynopsisText>SB 1909 (H-AM 2) will not impact any public pension fund or retirement system in Illinois. </SynopsisText><synopsistitle>State Debt Impact Note, House Floor Amendment No. 2 (Government Forecasting & Accountability)</synopsistitle>
<SynopsisText>SB 1909 (H-AM 2) would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness. </SynopsisText><synopsistitle>Land Conveyance Appraisal Note, House Floor Amendment No. 2 (Dept. of Transportation)</synopsistitle>
<SynopsisText>No land conveyances are included in this bill, therefore, there are no appraisals to be filed. </SynopsisText><synopsistitle>Housing Affordability Impact Note, House Floor Amendment No. 2 (Housing Development Authority)</synopsistitle>
<SynopsisText>This bill will have no effect on the cost of constructing, purchasing, owning, or selling a single-family residence. </SynopsisText><synopsistitle>Fiscal Note, House Floor Amendment No. 2 (Dept. of Revenue)</synopsistitle>
<SynopsisText>The changes made by SB 1909 (H-AM 2) do not change the original estimate of State government losses from the Retailers' Occupation Tax, Use Tax, Service Occupation Tax, and Service Use Tax. The changes do limit the upper bound State loss insofar as they exclude several taxes previously included in the increment. The changes also reduce the estimate of potential sales tax losses to local governments by excluding from the increment taxes imposed pursuant to the Local Mass Transit District Act, the Metro-East Park and Recreation District Act, and the Flood Prevention District Act. </SynopsisText><synopsistitle>State Mandates Fiscal Note, House Floor Amendment No. 2 (Dept. of Commerce & Economic Opportunity)</synopsistitle>
