<reference>20 ILCS 2805/2.10</reference><aliasreference></aliasreference><reference>210 ILCS 45/3-101.5 new</reference><aliasreference></aliasreference><SynopsisText>     Amends the Department of Veterans Affairs Act and the Nursing Home Care Act. Provides that if there is a conflict between the provisions of the Department of Veterans Affairs Act and the provisions of the Nursing Home Care Act concerning an Illinois Veterans Home operated by the Illinois Department of Veterans' Affairs, then the provisions of the Department of Veterans Affairs Act shall apply. Provides that an Illinois Veterans Home licensed under the Nursing Home Care Act and operated by the Illinois Department of Veterans' Affairs is exempt from certain provisions of the Nursing Home Care Act, including provisions concerning license fees, licensing by municipalities, facility plan review, annual financial statements, violations and penalties, and actions by residents for injunctive and declaratory relief. Provides that such a Home is also exempt from provisions of the Nursing Home Care Act concerning standards for facilities, so long as the Home meets the standards for similar provisions required or regulated by the United States Department of Veterans Affairs. <reftype>Adds reference to:</reftype><reference>210 ILCS 45/3-308.5 new</reference><aliasreference></aliasreference><SynopsisText>Replaces everything after the enacting clause with provisions similar to those of the bill, amending the Department of Veterans Affairs Act and the Nursing Home Care Act, but with changes that include the following: (1) changes the specified provisions of the Nursing Home Care Act from which an Illinois Veterans Home is exempt; (2) provides that a monitor or receiver shall be placed in an Illinois Veterans Home only by court order or by agreement between the Director of Public Health, the Director of Veterans' Affairs, and the Secretary of the United States Department of Veterans Affairs; and (3) provides that the amount of a penalty or fine against a facility operated by or under the authority of the Department of Veterans' Affairs shall be offset by the cost of the plan of correction, capital improvements, or physical plant repairs. Provides that the Director of Public Health shall issue a Declaration to the Director of Veterans' Affairs confirming the citation of each Type "A" violation and request that immediate action be taken to protect the health and safety of the veterans in the facility.
