Davis and Robert Rita 1/11/2011HouseSession Sine Die 730 ILCS 5/3-8-7from Ch. 38, par. 1003-8-7 Amends the Unified Code of Corrections. Provides that a prisoner may be transferred to a super-maximum security institution only when, within one year of the date of the proposed transfer: (1) while incarcerated, the prisoner committed or attempted to commit acts of violence either: (i) which resulted in serious injury or death or (ii) in connection with any act of non-consensual sex; (2) the prisoner has engaged in 2 or more acts which caused serious disruption of prison operations; or (3) the prisoner has escaped or attempted to escape from within a security perimeter or custody, or both, or direct supervision. Provides that prisoners with serious mental illnesses shall not be transferred to a super-maximum security facility. Provides that the Department of Corrections shall review the status of all prisoners currently housed at a super-maximum security institution within 90 days of the effective date of the amendatory Act to determine whether they should continue to be housed at that facility. Prisoners already incarcerated for longer than one year may continue to be held at a super-maximum institution only on the basis of specified criteria and must be provided a hearing within 6 months of the effective date of the amendatory Act.Land Conveyance Appraisal Note (Dept. of Transportation) No land conveyances are included in HB 2633, therefore, there are no appraisals to be filed. State Debt Impact Note (Government Forecasting & Accountability) HB 2633 would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness. Pension Note (Government Forecasting & Accountability) HB 2633 will not impact any public pension fund or retirement system in Illinois. Housing Affordability Impact Note (Housing Development Authority) This bill will have no effect on the cost of constructing, purchasing, owning, or selling a single-family residence. Fiscal Note (Dept. of Human Services) Cost estimates are approximately $30,000 for travel and contractual costs. This assumes that the Committee would consist of several DHS staff and a couple of contractors. The contractual costs would be a Psychiatrist and a Registered Nurse to conduct the annual chart reviews. Travel expenses of $10,000 would be required for the Committee to visit Tamms once per year. Judicial Note (Admin Office of the Illinois Courts) Based on a review of HB 2633, it is possible that the bill could result in additional litigation thereby impacting the workload of judicial officers in the State. However, it is not possible to determine the extent of this impact. Balanced Budget Note (Office of Management and Budget) HB 2633 has no fiscal impact and does not add additional spending pressure to the General Revenue Fund or to the current Fiscal Year 2009 budget deficit.State Mandates Fiscal Note (Dept. of Commerce & Economic Opportunity) HB 2366 does not create a State mandate under the State Mandates Act. Home Rule Note (Dept. of Commerce & Economic Opportunity) HB 2633 does not pre-empt home rule authority.Fiscal Note (Dept of Corrections) HB 2633 does not have a Corrections Population or Fiscal Impact to the Department of Corrections.
