| AMENDMENT NO. ______. Amend Senate Bill 2858 as follows:

| on page 1, by replacing lines 8 through 10 with the following:

| "(a) For the purposes of this Section, "trans fat" means |
| 5 |
| fat that is considered trans fat by the U.S. Food and Drug |
| 6 |
| Administration. "Trans fat" does not include naturally |
| 7 |
| occurring trans fat. Food shall be deemed to contain trans fat |
| 8 |
| under this Section if the food is labeled as, lists as an |
| 9 |
| ingredient, or contains any kind of partially hydrogenated |
| 10 |
| vegetable oil, including without limitation vegetable |
| 11 |
| shortening or margarine. However, food shall not be deemed to |
| 12 |
| contain trans fat under this Section if the food contains less |
| 13 |
| than 0.5 grams of trans fat per serving.".
