| AN ACT concerning criminal law.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Criminal Identification Act is amended by |
| 5 |
| adding Section 9.5 as follows: |
| 6 |
| (20 ILCS 2630/9.5 new) |
| 7 |
| Sec. 9.5. Material for DNA fingerprint analysis. Every |
| 8 |
| county medical examiner and coroner shall provide to the |
| 9 |
| Department a sample of dried blood and buccal specimens (tissue |
| 10 |
| may be submitted if no uncontaminated blood or buccal specimens |
| 11 |
| can be obtained) from a dead body for DNA fingerprint analysis |
| 12 |
| if the Department notifies the medical examiner or coroner that |
| 13 |
| the Department has determined that providing that sample may be |
| 14 |
| useful for law enforcement purposes in a criminal |
| 15 |
| investigation. In addition, if a local law enforcement agency |
| 16 |
| notifies a county medical examiner or coroner that such a |
| 17 |
| sample would be useful in a criminal examination, the county |
| 18 |
| medical examiner or coroner shall provide a sample to the local |
| 19 |
| law enforcement agency for submission to the Department.
