| AMENDMENT NO. ______. Amend Senate Bill 478 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Code of Civil Procedure is amended by |

| adding Section 15-1506.1 as follows:

| (735 ILCS 5/15-1506.1 new) |

| Sec. 15-1506.1. Voluntary dismissal. When a plaintiff
|
| 8 |
| voluntarily dismisses an action brought under this Article and
|
| 9 |
| an order has been previously entered that includes a clause
|
| 10 |
| finding that a condominium association or a unit owners'
|
| 11 |
| association, as that term is defined in subsection (c) of |
| 12 |
| Section
9-102, has a junior judgment or judgment in second |
| 13 |
| position
to that of the plaintiff, the voluntary dismissal |
| 14 |
| shall not
apply to the judgment of that party. If an |
| 15 |
| association with a judgment does
not file a motion to vacate |

| within 30 days of the date
