Grants a right of private action against violations of the Act. Makes other changes. Effective immediately.</SynopsisText><synopsistitle>Senate Floor Amendment No. 1</synopsistitle>
<SynopsisText>Deletes everything after the enacting clause. Reinserts the provisions of Senate Bill 2626 as introduced with the following changes: In the definition of "historic resource", removes the specification as to how the property is placed on the National Register. In the definition of "adverse effect", includes a proposed project's nonconformance with the Secretary of the Interior's Standards for Historic Preservation. Permits the Director, at the Director's discretion or when the Director is requested and agrees that there is substantial public interest (now, the bill does not specify initiative), to hold a public hearing before (i) finding that an undertaking does not adversely affect a historic resource, (ii) finding that there is no reasonable or feasible alternative, or (iii) entering into or modifying (now, entering into) a Memorandum of Agreement. Requires that the Director and the State agency consider matters presented at the hearing and document in writing their consideration of principal issues. Removes the bill's grant of a private enforcement action for purposes of preventing occupancy or to prevent illegal acts, conduct, businesses, use, or abuse in or about the premises (retains the bill's other purposes for a private enforcement action).
