<reference>65 ILCS 5/11-19-1</reference><aliasreference>from Ch. 24, par. 11-19-1</aliasreference><SynopsisText>Amends the Illinois Municipal Code. Provides that no municipality with a population of less than 1,000,000 may award a franchise to a private entity for the collection of waste from non-residential locations without first: (i) holding at least one public hearing; (ii) providing at least 45 days' written notice of the hearing to all private entities that provide non-residential waste collection services within the municipality; and (iii) providing public notice of the hearing. Requires the municipality to provide at least 3 years' notice to all private entities then providing waste collection services to non-residential locations within the municipality before awarding a franchise to a private entity for the collection of waste from non-residential locations. <SynopsisText>Provides that the hearing requirements apply only if the municipality has never awarded a franchise to a private entity for the collection of waste from non-residential locations. Provides that, at the public hearing, the municipality must disclose and discuss the franchise fee or portion of payment of collection services that it will receive under the proposed franchise. <SynopsisText>Deletes everything after the enacting clause. Reinserts the provisions of the bill as amended by Senate Amendment No. 1 with changes. Provides that a private entity may not provide waste collection services to non-residential locations under a first-time franchise agreement with a municipality before the date that is 15 months after the date the ordinance or resolution approving the award of the franchise is adopted. Provides that the municipality may not award a franchise agreement without first providing at least 30 days' (replaces 45 days') written notice of the franchise hearing to all private entities that provide non-residential waste collection services within the municipality that the municipality is able to identify through its records. Provides that, at the public hearing, the municipality must disclose the calculation formula of such franchise fee (replaces "portion of payment of collection services") that it will receive under the proposed franchise. Makes other changes. Effective on October 1, 2008.</SynopsisText></synopsis>
