<reference>New Act</reference><aliasreference></aliasreference><SynopsisText>Creates the Access to Governmental Services Act. Requires each constitutional officer, State agency, circuit court clerk, and State program to take reasonable steps to provide equal access to public services for individuals with limited English proficiency, including: (i) having a sufficient number of qualified bilingual persons in public contact positions or as interpreters and (ii) translation of important documents ordinarily provided to the public into any language spoken by at least 3% of the overall population of the State, as measured by the U.S. Census. Requires the Illinois Human Rights Commission to implement a process to address disputes arising under the Act.</SynopsisText><synopsistitle>Senate Committee Amendment No. 1</synopsistitle>

<SynopsisText>The Department of Employment Security estimates it would incur in excess of $13 million in additional administrative costs as a result of SB 1448 (S-AM 1), but the fully stated total cost of the measure is not currently quantifiable.</SynopsisText><synopsistitle>Senate Floor Amendment No. 3</synopsistitle>
<SynopsisText>Replaces everything after the enacting clause with substantially the same provisions, except that each State agency, constitutional officer, and State program (instead of State agency, constitutional officer, circuit court clerk, or State program) shall: (1) be subject to the Act; and (2) adopt rules under the Act not more than (instead of not less than) 6 months after the effective date.</SynopsisText><synopsistitle>Senate Floor Amendment No. 5</synopsistitle>
<SynopsisText>Further amends the Access to Governmental Services Act. Provides that "Equal access" means to be able to interact with a State agency or constitutional office at a level equal to individuals who do not have limited English proficiency (instead of to be informed of, participate in, and benefit from public services offered by a State agency, constitutional office, or a State program). Deletes definition of "State program" and the applicability of the Act to "State programs". Provides that each State agency and constitutional officer shall take reasonable steps including the development and implementation of pilot programs or phase-in plans to provide equal access for individuals with limited English proficiency, including translations of important documents (instead of each State agency, constitutional officer, and State program shall take reasonable steps to provide equal access to public services). Provides for the translation of important documents into the (instead of any) language spoken by any limited English proficient population that is at least 3% of the State's population. Provides that the Department of Human Rights (instead of the Illinois Human Rights Commission) shall implement a process to handle disputes concerning "important documents" and bilingual public contact positions. Makes other corresponding changes.</SynopsisText><synopsistitle>Fiscal Note (Capital Development Board)</synopsistitle>
<SynopsisText>The Capital Development Board presently has a bi-lingual staff person who serves the Northern third of the State for all Hispanic related translation needs. The remainder of the State does not have weekly interaction with individuals who require such services. CDB holds outreach conferences to attract minority and female owned businesses to become a  part of the construction program. There would be a cost to translate the outreach materials into Spanish. The estimated cost in $15,000.</SynopsisText><synopsistitle>Fiscal Note (Office of the Secretary of State)</synopsistitle>
<SynopsisText>SB 1448 has a minimal fiscal impact on the Secretary of State's Office.</SynopsisText><synopsistitle>Fiscal Note (Dept. of Human Rights)</synopsistitle>
<SynopsisText>The fiscal impact of SB 1448 is as follows: Personal Services = $112,200; Employer Retirement (11.53%) = $12,937; Social Security (7.65%) = $8,583; Training = $5,000; Overhead Expenses = $10,800; Total Fiscal Impact = $149,520.</SynopsisText><synopsistitle>Fiscal Note (Dept. of Central Management Services)</synopsistitle>
<SynopsisText>The Department of Central Management Services estimates the cost of this legislation to be as follows: (1) Translation of documents - $1,500,000-$2,000,000, Per Language; (2) Web Page Translation and Maintenances &amp; Computer Updates -  CMS manages over 5,000 web pages, which would all require changes and ongoing maintenance. The one time changes would be in the tens of millions of dollars to convert to foreign languages. Ongoing maintenance would require 2-3 FTEs, per language, averaging approximately $360,000 per year; (3) Public Facing Bi-Lingual Personnel - $100,000 fully loaded cost per individual employee. Full staffing ration needed to satisfy this legislation is unknown at this time. </SynopsisText><synopsistitle>Fiscal Note (Office of the Auditor General)</synopsistitle>
<SynopsisText>The fiscal impact for SB 1448 is as follows: 1 contractual interpreter @ $35 per hour for 150 hours = $5,250; Miscellaneous commodities = $200; Total Pilot Cost = $5,450.</SynopsisText><synopsistitle>Fiscal Note (Admin Office of the Illinois Courts)</synopsistitle>
<SynopsisText>While an increase on the demand for judicial resources would be necessary to comply with this Act, in addition to demands on judicial-related county resources, the specific fiscal impact cannot be determined at this time.</SynopsisText><synopsistitle>Fiscal Note (Financial &amp; Professional Regulation)</synopsistitle>
<SynopsisText>SB 1448 (S-AM 1, 3, 5) will have a minimal fiscal impact to the Illinois Department of Financial and Professional Regulation. Documents for transactions does not include licensing documents so there would be a minimal fiscal impact to the agency. However, this legislation may subject other State agencies to additional fiscal responsibilities. </SynopsisText></synopsis>
