<reference>730 ILCS 5/3-5-5 new</reference><aliasreference></aliasreference><SynopsisText>     Amends the Unified Code of Corrections. Provides that upon admission of a committed person to a facility of the Department of Corrections or to a facility of the Department of Juvenile Justice and upon the discharge of such person from either such Department, each such Department, if it suspects that such person is an alien of the United States who is unlawfully present within the United States in violation of the federal Immigration and Nationality Act shall notify the Department of Homeland Security, U.S. Immigration and Customs Enforcement (ICE) of the admission or discharge of such alien from the facility.</SynopsisText><synopsistitle>House Amendment No. 1</synopsistitle>
<SynopsisText>Provides that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.</SynopsisText><synopsistitle>House Amendment No. 2</synopsistitle>

Amends the Unified Code of Corrections. Provides that the clerk of the court shall transmit to the department, agency or institution, if any, to which the defendant is committed, the defendant's immigration status as declared by the defendant in conjunction with the advisement issued by the court pursuant to the Code of Criminal Procedure of 1963; and the defendant's immigration status as declared by the defendant in conjunction with advisement issued by the court at the sentencing hearing. Provides that at the sentencing hearing for a conviction or plea of guilty to a misdemeanor or felony offense, the court shall give the following advisement to the defendant in open court: "If you are not a citizen of the United States, you are hereby advised that your conviction for the offense for which you have been found guilty or entered a plea of guilty may have consequences of deportation, exclusion from admission to the United States, or denial of naturalization under the laws of the United States." Provides that the Illinois Department of Corrections shall submit information it receives relating to immigration status for all defendants committed to a Department of Corrections facility to the U.S. Department of Immigration Customs Enforcement.
