Hendon-Christine Radogno-Susan Garrett) 1/13/2009HouseSession Sine Die New Act Creates the MRSA Screening, Prevention, and Reporting Act for State Residential Facilities. Requires State residential facilities to establish an MRSA control program. Defines "State residential facility" to mean: (i) Department of Human Services operated residential facilities, including State mental health hospitals and other facilities; (ii) Department of Veterans' Affairs operated veterans homes; (iii) Department of Corrections operated correctional centers, work camps or boot camps, and adult transition centers; and (iv) Department of Juvenile Justice operated juvenile centers and boot camps. Sets forth required features of the MRSA control program, including screening and surveillance, reporting, prevention, infection control, and treatment. Includes requirements for training of employees and others. Effective immediately.House Amendment No. 1 Replaces everything after the enacting clause with substantially similar provisions, creating the MRSA Screening, Prevention, and Reporting Act for State Residential Facilities, but with changes that include the following: (1) requires reporting of other antibiotic-resistant infections, as well as MRSA infections; (2) requires hand-hygiene training at least once (instead of twice) a year; (3) requires facilities to develop guidelines (instead of a plan) for isolating MRSA-diagnosed cases; (4) provides that an individual shall not be required to make a copayment for the testing or treatment of an MRSA infection; (5) provides that notification of an MRSA case must protect the identity of the infected individual; and (6) requires the Department of Public Health to develop an MRSA treatment protocol for each department operating a State residential facility (instead of requiring each such department to develop its own protocol). Effective immediately.House Amendment No. 2 Provides that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.House Amendment No. 3 Changes references to "MRSA control program", "hand hygiene program", and "sanitation program" to references to "MRSA control procedures", "hand hygiene procedures", and "sanitation procedures", respectively. Adds provisions concerning a visual inspection in connection with evaluations for skin infections. Provides that restrictions concerning transfer of a resident, patient, student, or inmate with a skin or soft tissue infection do not apply to discharges and are not intended to limit an individual's right to leave an institutional setting. Requires State residential facility management to inform employees that an occurrence of MRSA infection has been identified (instead of informing them "of the MRSA case").
