<reference>705 ILCS 40/1.1</reference><aliasreference>from Ch. 37, par. 72.41-1</aliasreference><SynopsisText>     Amends the Judicial Vacancies Act. Makes a technical change in a Section concerning definitions.</SynopsisText><synopsistitle>House Amendment No. 1</synopsistitle>
<reftype>Deletes reference to:</reftype><reference>705 ILCS 40/1.1</reference><aliasreference></aliasreference><reftype>Adds reference to:</reftype><reference>New Act</reference><aliasreference></aliasreference><SynopsisText>Replaces everything after the enacting clause. Creates the Mental Health Court Treatment Act. Provides that the Chief Judge of each judicial circuit may establish a mental health court program, including the format under which it operates under the Act. Provides that a defendant may be admitted into a mental health court program only upon the agreement of the prosecutor and the defendant and with the approval of the court. Excludes from eligibility for the program a defendant who has been convicted of a crime of violence within the past 10 years excluding incarceration time; a defendant who does not demonstrate a willingness to participate in a treatment program; or a defendant who has previously completed or has been discharged from a mental health court program within 3 years of completion or discharge. Establishes conditions of the program. Provides that upon successful completion of the terms and conditions of the program, the court may dismiss the original charges against the defendant or successfully terminate the defendant's sentence or otherwise discharge him or her from the program or from any further proceedings against him or her in the original prosecution.</SynopsisText></synopsis>
