Provides that the Illinois Commerce Commission, for reasons of safety and reliability, shall adopt rules to prohibit residential, commercial, and industrial customers from installing their own distribution facilities and equipment. Provides that the Commission shall have the authority to impose significant penalties to customers and electric utilities for a violation of specified provisions. Effective immediately.</SynopsisText><synopsistitle>House Amendment No. 1</synopsistitle>
<SynopsisText>Replaces everything after the enacting clause. Provides that no electric utility shall allow a retail customer or any person, corporation, or agent on behalf of such customer to install, operate, or maintain any electric distribution facility or equipment. Provides an exemption to the provision for retail customers of a municipal system or electric cooperative. Provides that employees of an electric utility that are obligated to install, operate, or maintain electric distribution facilities and equipment shall have an independent statutory cause of action to file a complaint against an electric utility, retail customer or person, corporation, or agent acting on behalf of a retail customer for alleged violations of the provision. Amends the Electric Service Customer Choice and Rate Relief Law of 1997 in the Public Utilities Act. Provides that no electric utility shall allow a retail customer or any person, corporation, or agent on behalf of such customer to install, operate, or maintain any electric distribution facility or equipment. Provides an exemption to the provision for retail customers of a municipal system or electric cooperative if they meet certain criteria. Provides that employees of an electric utility that are obligated to install, operate, or maintain electric distribution facilities and equipment shall have an independent statutory cause of action to file a complaint against an electric utility, retail customer or person, corporation, or agent acting on behalf of a retail customer for alleged violations of the provision. Provides that the Illinois Commerce Commission shall promulgate rules establishing deadlines by which electric utilities must install electric distribution facilities and equipment so retail customers can receive new electric service. Provides that the rules shall include provisions for retail customers to be credited by the electric utility for violations of new electric service deadlines as described in certain provisions. Provides that the rules shall require each electric utility to provide to the Commission, on a quarterly basis and in a form suitable for posting on the Commission's website, a public report that includes performance data for new electric service installations.
