Provides that the federally licensed firearm dealer shall conduct a background check on the prospective recipient of the firearm and follow all other applicable federal, State, and local laws as if he were the seller of the firearm. Provides that the purchaser or transferee may be required by the federally licensed firearm dealer to pay a fee not to exceed $10 per firearm, plus any applicable fees. Makes exceptions for (i) the transfer of a firearm between spouses, a parent and child, or a grandparent and grandchild, (ii) transfers by persons acting pursuant to operation of law or a court order, or (iii) transfers on the grounds of a gun show.House Committee Amendment No. 1 Adds reference to:430 ILCS 65/1.1from Ch. 38, par. 83-1.1430 ILCS 65/3.1from Ch. 38, par. 83-3.1Replaces everything after the enacting clause. Provides that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.Land Conveyance Appraisal Note, House Floor Amendment No. 2 (Dept. of Transportation) No land conveyances are included in HB 758 (H-AM 2), therefore, there are no appraisals to be filed.Housing Affordability Impact Note, House Floor Amendment No. 2 (Housing Development Authority) This legislation will have no effect on constructing, purchasing, owning, or selling a single-family residence.Judicial Note, House Floor Amendment No. 2 (Admin Office of the Illinois Courts) This legislation would neither increase nor decrease the number of judges needed in the judicial branch.Home Rule Note, House Floor Amendment No. 2 (Dept. of Commerce & Economic Opportunity) This legislation does not pre-empt home rule authority.
