| AMENDMENT NO. ______. Amend Senate Bill 2868 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Capital Development Board Act is amended by |
| 5 |
| changing Section 10.09-5 as follows:
|

| (20 ILCS 3105/10.09-5)

| Sec. 10.09-5. Standards for an energy code. To adopt rules, |
| 8 |
| by January 1,
2004, implementing a statewide energy code for |
| 9 |
| the construction or repair of
State facilities described in |
| 10 |
| Section 4.01. The energy code adopted by the
Board shall |
| 11 |
| incorporate standards promulgated by the American Society of
|
| 12 |
| Heating, Refrigerating and Air-conditioning Engineers, Inc., |
| 13 |
| (ASHRAE). In
proposing rules, the Board shall consult with the |
| 14 |
| Department of Commerce and
Economic Opportunity
Community |
| 15 |
| Affairs.
|

Efficient Commercial Building Act is |

| amended by changing Section 10 as follows:

| Sec. 10. Definitions.
|

| "Board" means the Capital Development Board.
|
| 22 |
| "Code" means the latest published edition of the |
|

| International Code Council's International Energy Conservation |
| 2 |
| Code, excluding published supplements but including
2000 |
| 3 |
| International Energy Conservation Code, the ASHRAE 90.1-1999 |

| Standard, which is included within that Code, the 2001

| 5 |
| supplement to that Code, and the adaptations to the Code that |
| 6 |
| are made by the
Board.
|
| 7 |
| "Commercial building" means any building except a building |
| 8 |
| that is a residential building, as defined in this Section. |
| 9 |
| "Department" means the Department of Commerce and Economic |
| 10 |
| Opportunity. |
| 11 |
| "Municipality" means any city, village, or incorporated |
| 12 |
| town.
|
| 13 |
| "Residential building" means (i) a detached one-family or |
| 14 |
| 2-family dwelling or (ii) any building that is 3 stories or |
| 15 |
| less in height above grade that contains multiple dwelling |
| 16 |
| units, in which the occupants reside on a primarily permanent |
| 17 |
| basis, such as a townhouse, a row house, an apartment house, a |
| 18 |
| convent, a monastery, a rectory, a fraternity or sorority |
| 19 |
| house, a dormitory, and a rooming house.

| Section 99. Effective date. This Act takes effect upon |

| becoming law.".
