| AMENDMENT TO SENATE BILL 330

| AMENDMENT NO. ______. Amend Senate Bill 330 by replacing |

| lines 26 through 32 on page 1 and line 1 on page 2 with the |
| 4 |
| following: |
| 5 |
| "(d)(1) "Flavored cigarette" means a cigarette or any of |
| 6 |
| its component parts (including but not limited to the tobacco, |
| 7 |
| paper, or filter) that contains as a constituent (including a |
| 8 |
| smoke constituent) or additive a natural or artificial flavor |
| 9 |
| (other than tobacco or menthol) or a sweetener or herb or spice |
| 10 |
| or other additive that produces a natural or artificial flavor |
| 11 |
| (other than tobacco or menthol) that is a characterizing flavor |
| 12 |
| of the tobacco product or tobacco smoke. |
| 13 |
| (2) For purpose of this subsection (d), a cigarette or its |
| 14 |
| tobacco smoke shall be deemed to have a "characterizing flavor" |
| 15 |
| pursuant to paragraph (1) of this subsection (d) if it imparts |
| 16 |
| a distinguishable taste or aroma other than tobacco or menthol |
| 17 |
| either prior to or during consumption, or it or any component |
| 18 |
| part is advertised or marketed as having or producing a flavor, |
| 19 |
| taste, or aroma other than tobacco or menthol.".
