| 1 | AN ACT concerning employment.
| ||||||||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
| 3 | represented in the General Assembly:
| ||||||||||||||||||||||||||
| 4 | Section 1. Short title. This Act may be cited as the DHS | ||||||||||||||||||||||||||
| 5 | Child Care Provider Health Benefits Act. | ||||||||||||||||||||||||||
| 6 | Section 5. Definitions. In this Act: | ||||||||||||||||||||||||||
| 7 | "Child care provider" means a day care center, day care | ||||||||||||||||||||||||||
| 8 | home, or group day care home. The term also means an individual | ||||||||||||||||||||||||||
| 9 | who operates a day care home or group day care home. | ||||||||||||||||||||||||||
| 10 | "Day care center", "day care home", and "group day care | ||||||||||||||||||||||||||
| 11 | home" are defined as in the Child Care Act of 1969. The terms | ||||||||||||||||||||||||||
| 12 | include both facilities licensed under that Act and facilities | ||||||||||||||||||||||||||
| 13 | exempt from licensure under that Act.
| ||||||||||||||||||||||||||
| 14 | "Department" means the Department of Human Services.
| ||||||||||||||||||||||||||
| 15 | "Program" means the program of health benefits for child | ||||||||||||||||||||||||||
| 16 | care providers and employees established under this Act. | ||||||||||||||||||||||||||
| 17 | "Subsidized full-day child care services" means child care | ||||||||||||||||||||||||||
| 18 | services that are provided to a child for 5 or more hours per | ||||||||||||||||||||||||||
| 19 | day and are subsidized by the Department of Human Services | ||||||||||||||||||||||||||
| 20 | under Section 9A-11 of the Illinois Public Aid Code.
| ||||||||||||||||||||||||||
| 21 | Section 10. Health benefits program. | ||||||||||||||||||||||||||
| 22 | (a) A program of health benefits for child care providers | ||||||||||||||||||||||||||
| 23 | and their employees is established. A child care provider, and | ||||||||||||||||||||||||||
| 24 | any employee of such a child care provider who provides child | ||||||||||||||||||||||||||
| 25 | care services for 30 or more hours per week, is eligible to | ||||||||||||||||||||||||||
| 26 | participate in the program as provided in this Section if the | ||||||||||||||||||||||||||
| 27 | provider or employee meets the following requirements: | ||||||||||||||||||||||||||
| 28 | (1) The provider provides subsidized full-day child | ||||||||||||||||||||||||||
| 29 | care services to 3 or more children. For every 3 children | ||||||||||||||||||||||||||
| 30 | to whom a provider provides subsidized full-day child care | ||||||||||||||||||||||||||
| 31 | services, one employee of that provider is eligible to | ||||||||||||||||||||||||||
| |||||||
| |||||||
| 1 | participate in the program. | ||||||
| 2 | (2) The provider or employee has provided those | ||||||
| 3 | services for at least 3 consecutive months immediately | ||||||
| 4 | preceding participation in the program. | ||||||
| 5 | A child care provider that is a day care center that | ||||||
| 6 | participates in the program must provide coverage under the | ||||||
| 7 | program for each employee who provides child care services for | ||||||
| 8 | 30 or more hours per week. A child care provider other than a | ||||||
| 9 | day care center may enroll in the program without providing | ||||||
| 10 | coverage for any employees, but if such a provider elects to | ||||||
| 11 | provide coverage for any employees, the provider must provide | ||||||
| 12 | coverage for each employee who provides child care services for | ||||||
| 13 | 30 or more hours per week. | ||||||
| 14 | (b) The program shall provide coverage of medical services | ||||||
| 15 | to the same extent as provided under the program of medical | ||||||
| 16 | assistance under Article V of the Illinois Public Aid Code. | ||||||
| 17 | (c) A child care provider or employee eligible under this | ||||||
| 18 | Section and participating in the program shall pay a fee of $10 | ||||||
| 19 | for each month during which the provider or employee | ||||||
| 20 | participates in the program. In addition, the provider or | ||||||
| 21 | employee shall pay the following fees as co-payments: | ||||||
| 22 | (1) $10 for each visit to a provider of physician | ||||||
| 23 | services, dental services, optical services and supplies, | ||||||
| 24 | chiropractic services, podiatry services, or encounter | ||||||
| 25 | rate clinic services. | ||||||
| 26 | (2) $10 for each prescription filled by a provider of | ||||||
| 27 | pharmacy services.
| ||||||
| 28 | Section 15. Subsidized child care for fewer than 3 | ||||||
| 29 | children. | ||||||
| 30 | (a) A child care provider that provides subsidized full-day | ||||||
| 31 | child care services to fewer than 3 children, and any employee | ||||||
| 32 | of such a child care provider, is eligible to participate in | ||||||
| 33 | the program as provided in this Section. | ||||||
| 34 | (b) The Department shall determine the market rate for | ||||||
| 35 | health benefits provided under the program, based on actuarial | ||||||
| |||||||
| |||||||
| 1 | estimates. The Department shall revise the market rate | ||||||
| 2 | annually. | ||||||
| 3 | (c) A child care provider who does not provide subsidized | ||||||
| 4 | full-day child care services to any children, or an employee of | ||||||
| 5 | such a child care provider, is eligible to participate in the | ||||||
| 6 | program upon the payment of a fee equal to the market rate | ||||||
| 7 | determined by the Department under this Section.
| ||||||
| 8 | (d) A child care provider who provides subsidized full-day | ||||||
| 9 | child care services to one child, or an employee of such a | ||||||
| 10 | child care provider, is eligible to participate in the program | ||||||
| 11 | upon the payment of a fee equal to two-thirds of the market | ||||||
| 12 | rate determined by the Department under this Section.
| ||||||
| 13 | (e) A child care provider who provides subsidized full-day | ||||||
| 14 | child care services to 2 children, or an employee of such a | ||||||
| 15 | child care provider, is eligible to participate in the program | ||||||
| 16 | upon the payment of a fee equal to one-third of the market rate | ||||||
| 17 | determined by the Department under this Section.
| ||||||
| 18 | Section 20. DHS Child Care Provider Health Benefits Fund. | ||||||
| 19 | (a) The DHS Child Care Provider Health Benefits Fund is | ||||||
| 20 | created as a special fund in the State treasury. The fund shall | ||||||
| 21 | consist of the following: | ||||||
| 22 | (1) Moneys paid to the Department by child care | ||||||
| 23 | providers under Section 15. | ||||||
| 24 | (2) Moneys appropriated to the Department for the | ||||||
| 25 | purpose of administering the program. | ||||||
| 26 | (3) Federal grant moneys, or moneys from any other | ||||||
| 27 | public or private source, allocated to the Department for | ||||||
| 28 | the purpose of administering the program. | ||||||
| 29 | All moneys described in items (1), (2), and (3) of this | ||||||
| 30 | subsection shall be deposited into the fund. | ||||||
| 31 | (b) The Department shall use the moneys in the fund for the | ||||||
| 32 | purpose of administering the program, including the payment of | ||||||
| 33 | moneys to another entity pursuant to a contract entered into | ||||||
| 34 | between the Department and the entity under Section 25.

| 1 | Section 25. Program administration. The Department may | ||||||
| 2 | administer the program or may contract with another entity for | ||||||
| 3 | the administration of the program. | ||||||
| 4 | Section 90. The State Finance Act is amended by adding | ||||||
| 5 | Section 5.640 as follows: | ||||||
| 6 | (30 ILCS 105/5.640 new) | ||||||
| 7 | Sec. 5.640. The DHS Child Care Provider Health Benefits | ||||||
| 8 | Fund.
| ||||||
| 9 | Section 99. Effective date. This Act takes effect upon | ||||||
| 10 | becoming law.
| ||||||
