| AMENDMENT TO HOUSE BILL 3443

| AMENDMENT NO. ______. Amend House Bill 3443 on page 2, by |

| replacing lines 5 through 33 with the following: |

| "provided.

| The standards must include a provision that permits any |
| 6 |
| person who would otherwise qualify for community care services |
| 7 |
| except for the fact that he or she possesses nonexempt assets |
| 8 |
| in excess of any maximum asset limitations set by Department |
| 9 |
| rule to qualify for the community care services by entering |
| 10 |
| into an agreement with the Department regarding the person's |
| 11 |
| responsibility for payment for the costs of the community care |
| 12 |
| services, taking into consideration the amount of the excess |
| 13 |
| assets. The Department must adopt rules to administer the |
| 14 |
| provisions of this paragraph, including rules concerning the |
| 15 |
| terms and conditions of any agreement by which a person must |
| 16 |
| pay for services.".
