| AMENDMENT TO HOUSE BILL 1337

| AMENDMENT NO. ______. Amend House Bill 1337 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Election Code is amended by changing |
| 5 |
| Section 17-15 as follows:
|

| (10 ILCS 5/17-15) (from Ch. 46, par. 17-15)
|

| Sec. 17-15. Time off work to vote. If a registered voter |
| 8 |
| does not have sufficient time outside of his or her working |
| 9 |
| hours within which to vote at any regular election, the voter |
| 10 |
| may, without loss of pay for up to 2 hours, take off so much |
| 11 |
| working time as will, when added to the voter's voting time |
| 12 |
| outside of working hours, enable the voter to vote. |
| 13 |
| If an employee has 4 consecutive hours either between the |
| 14 |
| opening of the polls and the beginning of the working shift or |
| 15 |
| between the end of the working shift and the closing of the |
| 16 |
| polls, the voter shall be deemed to have sufficient time |
| 17 |
| outside working hours within which to vote. If the voter has |
| 18 |
| less than 4 consecutive hours, the voter may take off so much |
| 19 |
| working time as will when added to the voting time outside of |
| 20 |
| working hours enable the voter to vote, but not more than 2 |
| 21 |
| hours of which shall be without loss of pay; provided that the |
| 22 |
| voter shall be allowed time off for voting only at the |
| 23 |
| beginning or end of his or her working shift, as the employer |
| 24 |
| may designate, unless otherwise mutually agreed. |

| If the employee requires working time off to vote, the |
| 2 |
| voter shall notify his or her employer prior to the day before |
| 3 |
| the election that the voter requires time off to vote in |
| 4 |
| accordance with the provisions of this Section. |
| 5 |
| Not less than 10 working days before every election, every |
| 6 |
| employer shall post conspicuously in the place of work where it |
| 7 |
| can be seen as employees come or go to their place of work a |
| 8 |
| notice, to be prepared or approved by the Director of the |
| 9 |
| Illinois Department of Labor, setting forth the provisions of |
| 10 |
| this Section. The notice shall be kept posted until the close |
| 11 |
| of the polls on election day. |
| 12 |
| An employer shall not be obligated to pay the employee for |
| 13 |
| time off to vote unless the employee presents to the employer a |
| 14 |
| voter's receipt or other proof that the voter did, in fact, |
| 15 |
| vote on the election day.
Any person entitled to vote at a |
| 16 |
| general or special election or
at any election at which |
| 17 |
| propositions are submitted to a popular vote in
this State, |
| 18 |
| shall, on the day of such election, be entitled to absent
|
| 19 |
| himself from any services or employment in which he is then |
| 20 |
| engaged or
employed, for a period of 2 hours between the time |
| 21 |
| of opening and closing
the polls; and such voter shall not |
| 22 |
| because of so absenting himself be
liable to any penalty; |
| 23 |
| Provided, however, that application for such leave
of absence |
| 24 |
| shall be made prior to the day of election. The employer may
|
| 25 |
| specify the hours during which said employee may absent himself |
| 26 |
| as
aforesaid. No person or corporation shall refuse to an |
| 27 |
| employee the
privilege hereby conferred, nor shall subject an |
| 28 |
| employee to a penalty
because of the exercise of such |
| 29 |
| privilege, nor shall directly or indirectly
violate the |
| 30 |
| provisions of this section.

| Section 99. Effective date. This Act takes effect upon |

| becoming law.".
