AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Department of Health Professional Regulation Act.

Section 5. Department of Health Professional Regulation.

(a) The Department of Health Professional Regulation is created.

(b) The Department of Health Professional Regulation shall be under the direction of the Director of Health Professional Regulation, as provided in the Civil Administrative Code of Illinois. The Director may create administrative units within the Department and may assign functions, powers, duties, and personnel as necessary to carry out the functions and responsibilities vested in the Department.

(c) For purposes of the Successor Agency Act and for purposes of Section 9b of the State Finance Act, the Department of Health Professional Regulation is the successor agency to the Department of Financial and Professional Regulation with respect to the functions transferred to the Department of Health Professional Regulation under this Act.

Section 10. Functions transferred.

(a) All of the functions of the Department of Financial and Professional Regulation under each of the following Acts, and all of the powers, duties, rights, and responsibilities, including funding mechanisms, associated with or related to those functions and vested by law in the Department of Financial and Professional Regulation or in any office, division, council, committee, bureau, board, commission, officer, employee, or other individual or entity associated with the Department of Financial and Professional Regulation, are transferred to the Department of Health Professional Regulation:

(1) The Acupuncture Practice Act.

(2) The Illinois Athletic Trainers Practice Act.

(3) The Clinical Psychologist Licensing Act.

(4) The Clinical Social Work and Social Work Practice Act.

(5) The Illinois Dental Practice Act.

(6) The Dietetic and Nutrition Services Practice Act.

(7) The Environmental Health Practitioner Licensing Act.

(8) The Funeral Directors and Embalmers Licensing Code.

(9) The Home Medical Equipment and Services Provider License Act.

(10) The Marriage and Family Therapy Licensing Act.

(11) The Massage Licensing Act.

(12) The Medical Practice Act of 1987.

(13) The Naprapathic Practice Act.

(14) The Nursing and Advanced Practice Nursing Act.

(15) The Nursing Home Administrators Licensing and Disciplinary Act.

(16) The Illinois Occupational Therapy Practice Act.

(17) The Illinois Optometric Practice Act of 1987.

(18) The Mail Order Contact Lens Act.

(19) The Orthotics, Prosthetics, and Pedorthics Practice Act.

(20) The Pharmacy Practice Act of 1987.

(21) The Illinois Physical Therapy Act.

(22) The Physician Assistant Practice Act of 1987.

(23) The Podiatric Medical Practice Act of 1987.

(24) The Respiratory Care Practice Act.

(25) The Professional Counselor and Clinical Professional Counselor Licensing Act.

(26) The Illinois Speech-Language Pathology and Audiology Practice Act.

(27) The Wholesale Drug Distribution Licensing Act.

(28) The Perfusionist Practice Act.

(29) The Registered Surgical Assistant and Registered Surgical Technologist Title Protection Act.

(30) The Genetic Counselor Licensing Act.

(b) The functions, powers, duties, rights, and responsibilities transferred to the Department of Health Professional Regulation under this Act are not affected by this Act, except that they shall be carried out by the Department of Health Professional Regulation on and after the effective date of this Act.

Section 15. Representation on boards or other entities. When any provision of an Act provides for the membership of the Secretary of Financial and Professional Regulation on any council, commission, board, or other entity in connection with any function transferred to the Department of Health Professional Regulation under this Act, the Director of Health Professional Regulation, or the Director's designee, shall serve in that place. If more than one such person is required by law to serve on any council, commission, board, or other entity, then an equivalent number of representatives of the Department of Health Professional Regulation shall so serve.

Section 20. Employees transferred.

(a) The employees of the Department of Financial and Professional Regulation who are engaged in performing duties pertaining to any function transferred to the Department of Health Professional Regulation under this Act shall be transferred to the Department of Health Professional Regulation.

In the case of a person employed by the Department of Financial and Professional Regulation to perform both duties pertaining to a function transferred to the Department of Health Professional Regulation under this Act and duties pertaining to a function retained by the Department of Financial and Professional Regulation, the Director of Health Professional Regulation, in consultation with the Secretary of Financial and Professional Regulation, shall determine whether the employee shall be transferred to the Department of Health Professional Regulation. The employee shall not be transferred until this determination is made.

(b) The status and rights of employees transferred to the Department of Health Professional Regulation, and the rights of the State of Illinois and its agencies, under the Personnel Code and applicable collective bargaining agreements or under any pension, retirement, or annuity plan are not affected by that transfer or by any other provision of this Act.

Section 25. Books and records transferred. All books, records, papers, documents, property (real and personal), contracts, and pending business pertaining to any function transferred to the Department of Health Professional Regulation under this Act, including but not limited to material in electronic or magnetic format and necessary computer hardware and software, shall be delivered to the Department of Health Professional Regulation.

In the case of books, records, papers, documents, property, contracts, or pending business that pertains both to a function transferred to the Department of Health Professional Regulation under this Act and to a function retained by the Department of Financial and Professional Regulation, the Director of Health Professional Regulation, in consultation with the Secretary of Financial and Professional Regulation, shall determine whether the books, records, papers, documents, property, contracts, or pending business shall be transferred to the Department of Health Professional Regulation. The books, records, papers, documents, property, contracts, or pending business shall not be transferred until this determination is made.

Section 30. Unexpended moneys transferred. All unexpended appropriations and balances and other moneys available for use in connection with any function transferred to the Department of Health Professional Regulation under this Act shall be transferred for use by that Department for the exercise of those functions. Unexpended balances so transferred shall be expended only for the purpose for which the appropriations were originally made.

In the case of an unexpended appropriation that pertains both to a function transferred to the Department of Health Professional Regulation under this Act and to a function retained by the Department of Financial and Professional Regulation, the Director of Health Professional Regulation, in consultation with the Secretary of Financial and Professional Regulation, shall determine whether the unexpended appropriation shall be transferred to the Department of Health Professional Regulation. The unexpended appropriation shall not be transferred until this determination is made.

Section 35. Exercise of transferred powers; savings provisions. The powers, duties, rights, and responsibilities related to the functions transferred to the Department of Health Professional Regulation under this Act are vested in and shall be exercised by that Department. Each act done by the Department of Health Professional Regulation or any of its officers, employees, or agents in the exercise of those powers, duties, rights, and responsibilities shall have the same legal effect as if done by the Department of Financial and Professional Regulation or the divisions, officers, employees, or agents of that agency. The transfer of functions to the Department of Health Professional Regulation under this Act does not affect any person's powers, duties, rights, or responsibilities arising out of those transferred functions, except as otherwise provided in this Act.

Section 40. Officers, employees, and agents; penalties. Every officer, employee, and agent of the Department of Health Professional Regulation is, for any offense, subject to the same penalty or penalties, civil or criminal, as are prescribed by the law in effect on the effective date of this Act for the same offense by any officer, employee, or agent whose powers, duties, rights, and responsibilities are transferred under this Act.

Section 45. Reports, notices, or papers. Whenever reports or notices are required to be made or given or papers or documents furnished or served by any person to or upon the Department of Financial and Professional Regulation in connection with any function transferred from that Department to the Department of Health Professional Regulation under this Act, the same shall be made, given, furnished, or served in the same manner to or upon the Department of Health Professional Regulation.

Section 50. Acts and actions unaffected by transfer. This Act does not affect any act done, ratified, or canceled, or any right occurring or established, before the effective date of this Act in connection with any function transferred from the Department of Financial and Professional Regulation to the Department of Health Professional Regulation under this Act. This Act does not affect any action or proceeding had or commenced before the effective date of this Act in an administrative, civil, or criminal cause regarding the Department of Financial and Professional Regulation, but any such action or proceeding may be prosecuted, defended, or continued by the Department of Health Professional Regulation.

Section 55. Rules.

(a) Any rule of the Department of Financial and Professional Regulation that (i) relates to any function transferred from the Department of Financial and Professional Regulation to the Department of Health Professional Regulation under this Act, (ii) was in full force on the effective date of this Act, and (iii) was duly adopted by the Department of Financial and Professional Regulation shall become the rule of the Department of Health Professional Regulation. This Act does not affect the legality of any such rules contained in the Illinois Administrative Code.

(b) Any proposed rule filed with the Secretary of State by the Department of Financial and Professional Regulation that was pending in the rulemaking process on the effective date of this Act and that pertains to any function transferred from the Department of Financial and Professional Regulation to the Department of Health Professional Regulation under this Act shall be deemed to have been filed by the Department of Health Professional Regulation.

(c) As soon as practicable after the effective date of this Act, the Department of Health Professional Regulation shall revise and clarify the rules transferred to it under this Section to reflect the reorganization of functions effected by this Act, using the procedures for recodification of rules available under the Illinois Administrative Procedure Act, except that existing title, part, and section numbering for the affected rules may be retained. The Department of Health Professional Regulation may propose and adopt other rules as necessary for the purpose of revising and clarifying the rules transferred to the Department under this Section.

Section 905. The Civil Administrative Code of Illinois is amended by changing Sections 5-15 and 5-20 and by adding Section 5-347 as follows:

The Department of Agriculture.

The Department of Central Management Services.

The Emergency Management Agency.

The Department of Financial Institutions.

The Department of Health Professional Regulation.

The Department of Human Rights.

Sec. 5-20. Heads of departments. Each department shall have an officer as its head who shall be known as director or secretary and who shall, subject to the provisions of the Civil Administrative Code of Illinois, execute the powers and discharge the duties vested by law in his or her respective department.

The following officers are hereby created:

Sec. 5-347. In the Department of Health Professional Regulation. The Director of Health Professional Regulation is entitled to an annual salary as set by the Governor or as set by the Compensation Review Board, whichever is greater.
