| 1 | AN ACT concerning volunteer emergency workers.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Volunteer Firefighter Job Protection Act is | ||||||
| 5 | amended by changing Sections 1, 3, 5, and 20 as follows: | ||||||

| 7 | Sec. 1. Short title. This Act may be cited as the | ||||||
| 8 | Volunteer Emergency Worker
Firefighter
Job
Protection Act.

| 11 | Sec. 3. Definitions. As used in this Act: | ||||||
| 12 | "Volunteer emergency worker
firefighter" means a | ||||||
| 13 | firefighter who does not receive monetary compensation for his | ||||||
| 14 | or her services to a fire department or fire protection | ||||||
| 15 | district and who does not work for any other fire department or | ||||||
| 16 | fire protection district for monetary compensation. "Volunteer | ||||||
| 17 | emergency worker" also means a person who does not receive | ||||||
| 18 | monetary compensation for his or her services as a volunteer | ||||||
| 19 | Emergency Medical Technician (licensed as an EMT-B, EMT-I, or | ||||||
| 20 | EMT-P under the Emergency Medical Services (EMS) Systems Act), | ||||||
| 21 | a volunteer ambulance driver or attendant, or a volunteer | ||||||
| 22 | "First Responder", as defined in Sec. 3.60 of the Emergency | ||||||
| 23 | Medical Services (EMT) Systems Act, to a fire department, fire | ||||||
| 24 | protection district, or other governmental entity and who does | ||||||
| 25 | not work in one of these capacities for any other fire | ||||||
| 26 | department, fire protection district, or governmental entity | ||||||
| 27 | for monetary compensation.
| ||||||
| 28 | "Monetary compensation" does not include a monetary | ||||||
| 29 | incentive awarded to a firefighter by the board of trustees of | ||||||
| 30 | a fire protection district under Section 6 of the Fire | ||||||
| 31 | Protection District Act.

| 3 | Sec. 5. Volunteer emergency worker
firefighter; when | ||||||
| 4 | termination of employment prohibited.
| ||||||
| 5 | (a) No public or private employer may terminate an employee | ||||||
| 6 | who is a
volunteer
emergency worker
firefighter because the | ||||||
| 7 | employee, when acting as a volunteer emergency worker
| ||||||
| 8 | firefighter, is
absent from or late to his or her employment in | ||||||
| 9 | order to respond to an
emergency prior to the time the employee | ||||||
| 10 | is to report to his or her place of
employment.
| ||||||
| 11 | (b) An employer may charge, against the employee's regular | ||||||
| 12 | pay, any time
that
an
employee who is a
volunteer emergency | ||||||
| 13 | worker
firefighter loses from employment because of the | ||||||
| 14 | employee's
response to an emergency in the course of performing | ||||||
| 15 | his or her duties as a
volunteer emergency worker
firefighter.

| 16 | (c) In the case of an employee who is a
volunteer emergency | ||||||
| 17 | worker
firefighter and who loses time
from his or her | ||||||
| 18 | employment in order to respond to an emergency in the course of
| ||||||
| 19 | performing his or her duties as a volunteer emergency worker
| ||||||
| 20 | firefighter, the
employer has the right to request the employee | ||||||
| 21 | to provide the
employer with a written statement from the | ||||||
| 22 | supervisor or acting supervisor of
the
volunteer fire | ||||||
| 23 | department or governmental entity that the volunteer emergency | ||||||
| 24 | worker serves stating that the employee responded to an | ||||||
| 25 | emergency
and stating the time and date of the emergency.
| ||||||
| 26 | (d) An employee who is a
volunteer emergency worker
| ||||||
| 27 | firefighter and who may be absent from or late to his or her
| ||||||
| 28 | employment in
order to respond to an emergency in the course of | ||||||
| 29 | performing his or her duties
as a volunteer emergency worker
| ||||||
| 30 | firefighter must make a reasonable effort to notify his
or
her | ||||||
| 31 | employer that he or she may be absent or late.

| 34 | Sec. 20. Applicability. This Act does not apply to any | ||||||
| |||||||
| |||||||
| 1 | employer that is a municipality
applies only to municipalities | ||||||
| 2 | with a population of 3,500 or more
less.
