In the Elder Abuse and Neglect Act: (1) in the definition of "mandated reporter", removes references to "professional" and adds certain financial institutions as mandated reporters; (2) adds definitions of "protective services" and "self-neglect", and requires that suspected self-neglect be reported under the Act; (3) requires that a law enforcement officer accompany the representative of a provider agency on the first visit to a victim; (4) makes changes concerning the investigation of reports under the Act; (5) adds entities entitled to access to records of reports under the Act; (6) provides for cooperation between the Department on Aging and local law enforcement agencies; (7) authorizes actions to be taken in an emergency; and (8) makes other changes. In provisions of the Criminal Code of 1961 concerning the offense of financial exploitation of an elderly person or a person with a disability, (i) in the definition of "person with a disability", removes a reference to a "permanent" impairment and (ii) provides that "intimidation" also means the communication to an elderly person or a person with a disability that he or she will be deprived of contact with family members or a care provider or will be unnecessarily moved from his or her current residence to another residence or to a facility.</SynopsisText><synopsistitle>House Amendment No. 1</synopsistitle>
<reftype>Adds reference to:</reftype><reference>320 ILCS 20/3</reference><aliasreference>from Ch. 23, par. 6603</aliasreference><reference>320 ILCS 20/3.5</reference><aliasreference></aliasreference><reference>320 ILCS 20/4.2</reference><aliasreference></aliasreference><SynopsisText>Replaces everything after the enacting clause with provisions similar to those of House Bill 4024, amending the Elder Abuse and Neglect Act and the Criminal Code of 1961, but with changes that include the following in connection with the Elder Abuse and Neglect Act: (1) provides that a "domestic living situation" does not include an assisted living or shared housing establishment or a supportive living arrangement; (2) provides that "eligible adult" includes a person age 60 or older who neglects himself or herself; (3) in the definition of "mandated reporter", restores references to "professional" and deletes references to financial institutions; (4) removes the definition of "protective services"; (5) changes the definition of "self-neglect" and adds references to self-neglect; (6) adds provisions concerning face-to-face assessments, casework, and follow-up reports with respect to self-neglect, and removes a requirement that a law enforcement officer accompany a provider agency representative on a first visit to an alleged victim; (7) provides for collaboration between the Department on Aging and other entities to develop a protocol for the referral of cases and other matters; (8) makes changes in connection with access to records; and (9) removes provisions concerning emergencies in connection with the authority to consent to services. </SynopsisText></synopsis>
