| AN ACT concerning health care.
|
| 2 |
| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Health Care Surrogate Act is amended by |
| 5 |
| changing Section 55 as follows:
|
| 6 |
| (755 ILCS 40/55) (from Ch. 110 1/2, par. 851-55)
|

| Sec. 55. Preservation of existing rights. The provisions
of |
| 8 |
| this Act are cumulative with existing law regarding an
|
| 9 |
| individual's right to consent or refuse to consent to medical
|
| 10 |
| treatment. The provisions of this Act shall not impair any
|
| 11 |
| existing rights or responsibilities that a health care |
| 12 |
| provider, a
patient, including a minor or a patient lacking |
| 13 |
| decisional
capacity, or a patient's family may have in regard |
| 14 |
| to the
withholding or withdrawal of life-sustaining treatment, |
| 15 |
| including
any rights to seek judicial review of decisions |
| 16 |
| regarding
life-sustaining treatment under the common law or |
| 17 |
| statutes of Illinois
this
State to the extent they are not |
| 18 |
| inconsistent with the provisions
of this Act.
