    AN ACT concerning taxes.

    Be it enacted by the People of the State of Illinois,
 
3
represented in the General Assembly:

    Section 5. The Telecommunications Infrastructure 
5
Maintenance Fee Act is amended  by changing Section 25 as 
6
follows:

    (35 ILCS 635/25)

    Sec. 25. Collection, enforcement, and administration of 
9
State
telecommunications infrastructure maintenance fees.

    (a) A telecommunications retailer shall charge each 
11
customer an additional
charge equal to the State infrastructure

12
maintenance fee attributable to that customer's service 
13
address.  Such additional charge shall be shown separately
on 
14
each
the bill to the
each customer.

    (b) The State infrastructure maintenance fee shall be 
16
designated as a replacement for the personal
property
tax and 
17
shall be remitted by the telecommunications retailer to the 
18
Department; provided, however, that the
telecommunications 
19
retailer
may retain an amount not to exceed 2% of the State 
20
infrastructure maintenance
fee paid to the
Department, with a 
21
timely paid and timely filed return to reimburse itself for

22
expenses incurred in collecting, accounting for, and remitting 
23
the State infrastructure maintenance fee.  All
amounts herein 
24
remitted to the Department shall be transferred to the Personal

25
Property Tax Replacement Fund in the State Treasury.
