| 1 | | care center for use solely or primarily for children's |
| 2 | | recreation. |
| 3 | | "Residential care facility" means a care facility licensed |
| 4 | | for 24-hour medical or non-medical care of people in need of |
| 5 | | supervision or assistance essential for daily living or for |
| 6 | | the protection of the individual. "Residential care facility" |
| 7 | | includes assisted living facilities, independent living |
| 8 | | facilities, nursing homes, hospice facilities, and continuum |
| 9 | | of care facilities. "Residential care facility" does not |
| 10 | | include community residences or transitional treatment |
| 11 | | facilities. |
| 12 | | "Restaurant" has the meaning given to that term in the |
| 13 | | Smoke Free Illinois Act. |
| 14 | | "Vehicle impact protection device" means a concrete or |
| 15 | | metal barrier that is designed to protect people and property |
| 16 | | from moving vehicles. "Vehicle impact protection device" |
| 17 | | includes, but is not limited to, a bollard or decorative |
| 18 | | planter designed to protect people and property from moving |
| 19 | | vehicles. |
| 20 | | Section 10. Vehicle impact protection device requirements. |
| 21 | | (a) The owner or operator of a residential care facility |
| 22 | | shall install and maintain vehicle impact protection devices |
| 23 | | in front of all public entrances of the facility. |
| 24 | | (b) The owner or operator of a restaurant shall install |
| 25 | | and maintain vehicle impact protection devices: |

| 1 | | (1) if the restaurant is in an area zoned as a business |
| 2 | | or manufacturing district, in front of all public |
| 3 | | entrances of the restaurant; and |
| 4 | | (2) if the restaurant has an outdoor dining area, then |
| 5 | | around any outdoor dining area. |
| 6 | | (c) The owner or operator of a day care center shall |
| 7 | | install and maintain vehicle impact protection devices: |
| 8 | | (1) if the day care center is in an area zoned as a |
| 9 | | business or manufacturing district, in front of all public |
| 10 | | entrances of the day care center; and |
| 11 | | (2) if the day care center has an outdoor play area, |
| 12 | | then around any outdoor play area. |
| 13 | | Section 15. Standards for vehicle impact protection |
| 14 | | devices. |
| 15 | | (a) Vehicle protection devices required under this Act |
| 16 | | shall comply with the requirements of this Section. |
| 17 | | (b) The Department of Transportation shall adopt rules |
| 18 | | establishing the requirements for the vehicle impact |
| 19 | | protection devices required under this Act. |
| 20 | | (c) The vehicle impact protection devices shall be |
| 21 | | designed to withstand, at minimum, an impact resistance level |
| 22 | | of 5,000 pounds at 30 miles per hour. The devices must have a |
| 23 | | minimum height of 3 feet and must be spaced 48 inches from |
| 24 | | inside edge to inside edge of the device. Vehicle impact |
| 25 | | protection devices must not restrict access to the building |

| 1 | | and must be designed and installed to meet the requirements of |
| 2 | | the Illinois Accessibility Code and all other State and |
| 3 | | federal laws. |
| 4 | | (d) Vehicle impact protection devices may be located along |
| 5 | | the outside wall of a building, along the edge of an adjacent |
| 6 | | sidewalk, at the end of an adjacent parking space, or in other |
| 7 | | locations approved by the Department of Transportation. If |
| 8 | | vehicle impact protection devices are located within a parking |
| 9 | | space, then the parking space must be adequately sized to meet |
| 10 | | the requirements set by units of local government with |
| 11 | | jurisdiction over the parking space. |
| 12 | | (e) A municipality may, by ordinance, require vehicle |
| 13 | | impact protection devices installed within the municipality to |
| 14 | | be manufactured from finished metal or have a decorative cover |
| 15 | | that is complementary to the design of the associated |
| 16 | | building, storefront, outdoor dining area, or day care center. |
| 17 | | (f) A county may, by ordinance, require vehicle impact |
| 18 | | protection devices installed within the county and outside the |
| 19 | | corporate limits of a municipality to be manufactured from |
| 20 | | finished metal or have a decorative cover that is |
| 21 | | complementary to the design of the associated building, |
| 22 | | storefront, outdoor dining area, or day care center. |
| 23 | | Section 20. Enforcement. The Department of Public Health |
| 24 | | shall require restaurants to comply with this Act. The |
| 25 | | Department of Public Health shall adopt rules to enforce this |

| 2 | | Section 900. The Nursing Home Care Act is amended by |
| 3 | | adding Section 3-225 as follows: |
| 4 | | (210 ILCS 45/3-225 new) |
| 5 | | Sec. 3-225. The Protection from Vehicle Impacts Act. |
| 6 | | (a) As used in this Section, "residential care facility" |
| 7 | | has the meaning given to that term in the Protection from |
| 8 | | Vehicle Impacts Act. |
| 9 | | (b) The Department shall require residential care |
| 10 | | facilities to comply with the Protection from Vehicle Impacts |
| 11 | | Act. The Department shall adopt rules to enforce this Section. |
| 12 | | Section 905. The Child Care Act of 1969 is amended by |
| 13 | | adding Section 18.2 as follows: |
| 14 | | (225 ILCS 10/18.2 new) |
| 15 | | Sec. 18.2. The Protection from Vehicle Impacts Act. |
| 16 | | (a) As used in this Section, "day care center" has the |
| 17 | | meaning given to that term in the Protection from Vehicle |
| 18 | | Impacts Act. |
| 19 | | (b) The Department of Early Childhood shall require day |
| 20 | | care centers to comply with the Protection from Vehicle |
| 21 | | Impacts Act. The Department of Early Childhood shall adopt |
| 22 | | rules to enforce this Section.". |
