AMENDMENT TO SENATE BILL 2952

AMENDMENT NO. ______. Amend Senate Bill 2952 by replacing everything after the enacting clause with the following:

"Section 1. Short title. This Act may be cited as the Protection from Vehicle Impacts Act.

Section 5. Definitions. As used in this Act:

"Day care center" means an establishment providing care for more than 3 adults or children in a protective setting for less than 24 hours per day that is not located within a residential dwelling unit. "Day care center" does not include day care programs operated by an elementary school, middle school, high school, park, or place of worship.

"Outdoor dining area" means an outdoor seating area for a restaurant.

"Outdoor play area" means an outdoor area owned or controlled by a day care center that is designated by the day care center for use solely or primarily for children's recreation.

"Residential care facility" means a care facility licensed for 24-hour medical or non-medical care of people in need of supervision or assistance essential for daily living or for the protection of the individual. "Residential care facility" includes assisted living facilities, independent living facilities, nursing homes, hospice facilities, and continuum of care facilities. "Residential care facility" does not include community residences or transitional treatment facilities.

"Restaurant" has the meaning given to that term in the Smoke Free Illinois Act.

"Vehicle impact protection device" means a concrete or metal barrier that is designed to protect people and property from moving vehicles. "Vehicle impact protection device" includes, but is not limited to, a bollard or decorative planter designed to protect people and property from moving vehicles.

Section 10. Vehicle impact protection device requirements.

(a) The owner or operator of a residential care facility shall install and maintain vehicle impact protection devices in front of all public entrances of the facility.

(b) The owner or operator of a restaurant shall install and maintain vehicle impact protection devices:

(1) if the restaurant is in an area zoned as a business or manufacturing district, in front of all public entrances of the restaurant; and

(2) if the restaurant has an outdoor dining area, then around any outdoor dining area.

(c) The owner or operator of a day care center shall install and maintain vehicle impact protection devices:

(1) if the day care center is in an area zoned as a business or manufacturing district, in front of all public entrances of the day care center; and

(2) if the day care center has an outdoor play area, then around any outdoor play area.

Section 15. Standards for vehicle impact protection devices.

(a) Vehicle protection devices required under this Act shall comply with the requirements of this Section.

(b) The Department of Transportation shall adopt rules establishing the requirements for the vehicle impact protection devices required under this Act.

(c) The vehicle impact protection devices shall be designed to withstand, at minimum, an impact resistance level of 5,000 pounds at 30 miles per hour. The devices must have a minimum height of 3 feet and must be spaced 48 inches from inside edge to inside edge of the device. Vehicle impact protection devices must not restrict access to the building and must be designed and installed to meet the requirements of the Illinois Accessibility Code and all other State and federal laws.

(d) Vehicle impact protection devices may be located along the outside wall of a building, along the edge of an adjacent sidewalk, at the end of an adjacent parking space, or in other locations approved by the Department of Transportation. If vehicle impact protection devices are located within a parking space, then the parking space must be adequately sized to meet the requirements set by units of local government with jurisdiction over the parking space.

(e) A municipality may, by ordinance, require vehicle impact protection devices installed within the municipality to be manufactured from finished metal or have a decorative cover that is complementary to the design of the associated building, storefront, outdoor dining area, or day care center.

(f) A county may, by ordinance, require vehicle impact protection devices installed within the county and outside the corporate limits of a municipality to be manufactured from finished metal or have a decorative cover that is complementary to the design of the associated building, storefront, outdoor dining area, or day care center.

Section 20. Enforcement. The Department of Public Health shall require restaurants to comply with this Act. The Department of Public Health shall adopt rules to enforce this Section.

Section 900. The Nursing Home Care Act is amended by adding Section 3-225 as follows:

Sec. 3-225. The Protection from Vehicle Impacts Act.

(a) As used in this Section, "residential care facility" has the meaning given to that term in the Protection from Vehicle Impacts Act.

(b) The Department shall require residential care facilities to comply with the Protection from Vehicle Impacts Act. The Department shall adopt rules to enforce this Section.

Section 905. The Child Care Act of 1969 is amended by adding Section 18.2 as follows:

Sec. 18.2. The Protection from Vehicle Impacts Act.

(a) As used in this Section, "day care center" has the meaning given to that term in the Protection from Vehicle Impacts Act.

(b) The Department of Early Childhood shall require day care centers to comply with the Protection from Vehicle Impacts Act. The Department of Early Childhood shall adopt rules to enforce this Section.".
