AMENDMENT TO SENATE BILL 2952

2    AMENDMENT NO. ______. Amend Senate Bill 2952 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Protection from Vehicle Impacts Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Day care center" means an establishment providing care
8for more than 3 adults or children in a protective setting for
9less than 24 hours per day that is not located within a
10residential dwelling unit. "Day care center" does not include
11day care programs operated by an elementary school, middle
12school, high school, park, or place of worship.
13    "Outdoor dining area" means an outdoor seating area for a
14restaurant.
15    "Outdoor play area" means an outdoor area owned or
16controlled by a day care center that is designated by the day

1care center for use solely or primarily for children's
2recreation.
3    "Residential care facility" means a care facility licensed
4for 24-hour medical or non-medical care of people in need of
5supervision or assistance essential for daily living or for
6the protection of the individual. "Residential care facility"
7includes assisted living facilities, independent living
8facilities, nursing homes, hospice facilities, and continuum
9of care facilities. "Residential care facility" does not
10include community residences or transitional treatment
11facilities.
12    "Restaurant" has the meaning given to that term in the
13Smoke Free Illinois Act.
14    "Vehicle impact protection device" means a concrete or
15metal barrier that is designed to protect people and property
16from moving vehicles. "Vehicle impact protection device"
17includes, but is not limited to, a bollard or decorative
18planter designed to protect people and property from moving
19vehicles.
 
20    Section 10. Vehicle impact protection device requirements.
21    (a) The owner or operator of a residential care facility
22shall install and maintain vehicle impact protection devices
23in front of all public entrances of the facility.
24    (b) The owner or operator of a restaurant shall install
25and maintain vehicle impact protection devices:

1        (1) if the restaurant is in an area zoned as a business
2    or manufacturing district, in front of all public
3    entrances of the restaurant; and
4        (2) if the restaurant has an outdoor dining area, then
5    around any outdoor dining area.
6    (c) The owner or operator of a day care center shall
7install and maintain vehicle impact protection devices:
8        (1) if the day care center is in an area zoned as a
9    business or manufacturing district, in front of all public
10    entrances of the day care center; and
11        (2) if the day care center has an outdoor play area,
12    then around any outdoor play area.
 
13    Section 15. Standards for vehicle impact protection
14devices.
15    (a) Vehicle protection devices required under this Act
16shall comply with the requirements of this Section.
17    (b) The Department of Transportation shall adopt rules
18establishing the requirements for the vehicle impact
19protection devices required under this Act.
20    (c) The vehicle impact protection devices shall be
21designed to withstand, at minimum, an impact resistance level
22of 5,000 pounds at 30 miles per hour. The devices must have a
23minimum height of 3 feet and must be spaced 48 inches from
24inside edge to inside edge of the device. Vehicle impact
25protection devices must not restrict access to the building

1and must be designed and installed to meet the requirements of
2the Illinois Accessibility Code and all other State and
3federal laws.
4    (d) Vehicle impact protection devices may be located along
5the outside wall of a building, along the edge of an adjacent
6sidewalk, at the end of an adjacent parking space, or in other
7locations approved by the Department of Transportation. If
8vehicle impact protection devices are located within a parking
9space, then the parking space must be adequately sized to meet
10the requirements set by units of local government with
11jurisdiction over the parking space.
12    (e) A municipality may, by ordinance, require vehicle
13impact protection devices installed within the municipality to
14be manufactured from finished metal or have a decorative cover
15that is complementary to the design of the associated
16building, storefront, outdoor dining area, or day care center.
17    (f) A county may, by ordinance, require vehicle impact
18protection devices installed within the county and outside the
19corporate limits of a municipality to be manufactured from
20finished metal or have a decorative cover that is
21complementary to the design of the associated building,
22storefront, outdoor dining area, or day care center.
 
23    Section 20. Enforcement. The Department of Public Health
24shall require restaurants to comply with this Act. The
25Department of Public Health shall adopt rules to enforce this

2    Section 900. The Nursing Home Care Act is amended by
3adding Section 3-225 as follows:
 
4    (210 ILCS 45/3-225 new)
5    Sec. 3-225. The Protection from Vehicle Impacts Act.
6    (a) As used in this Section, "residential care facility"
7has the meaning given to that term in the Protection from
8Vehicle Impacts Act.
9    (b) The Department shall require residential care
10facilities to comply with the Protection from Vehicle Impacts
11Act. The Department shall adopt rules to enforce this Section.
 
12    Section 905. The Child Care Act of 1969 is amended by
13adding Section 18.2 as follows:
 
14    (225 ILCS 10/18.2 new)
15    Sec. 18.2. The Protection from Vehicle Impacts Act.
16    (a) As used in this Section, "day care center" has the
17meaning given to that term in the Protection from Vehicle
18Impacts Act.
19    (b) The Department of Early Childhood shall require day
20care centers to comply with the Protection from Vehicle
21Impacts Act. The Department of Early Childhood shall adopt
22rules to enforce this Section.".
