| 2 | | AMENDMENT NO. ______. Amend House Bill 5276 by replacing |
| 3 | | everything after the enacting clause with the following: |
| 4 | | "Section 5. The Public Official Safety and Privacy Act is |
| 5 | | amended by changing Section 10 as follows: |
| 6 | | (5 ILCS 347/10) |
| 7 | | Sec. 10. Definitions. As used in this Act: |
| 8 | | "Constitutional officers" means the officers established |
| 9 | | by Section 1 of Article V of the Illinois Constitution. |
| 10 | | "Governmental agency" includes all agencies, authorities, |
| 11 | | boards, commissions, departments, institutions, offices, and |
| 12 | | any other bodies politic and corporate of the State created by |
| 13 | | the constitution or statute, whether in the executive, |
| 14 | | judicial, or legislative branch; all units and corporate |
| 15 | | outgrowths created by executive order of the Governor or any |
| 16 | | constitutional officer, by the Supreme Court, or by resolution |

| 1 | | of the General Assembly; or agencies, authorities, boards, |
| 2 | | commissions, departments, institutions, offices, and any other |
| 3 | | bodies politic and corporate of a unit of local government, or |
| 4 | | school district. |
| 5 | | "Home address" includes a public official's permanent |
| 6 | | residence and any secondary residences affirmatively |
| 7 | | identified by the public official, but does not include a |
| 8 | | public official's work address. |
| 9 | | "Immediate family" includes a public official's spouse, |
| 10 | | child, or parent or any individual who is a blood relative of |
| 11 | | the public official or the public official's spouse and who |
| 12 | | lives in the same residence as the public official. |
| 13 | | "Personal information" means a home address, home |
| 14 | | telephone number, mobile telephone number, pager number, |
| 15 | | personal email address, social security number, federal tax |
| 16 | | identification number, checking and savings account numbers, |
| 17 | | credit card numbers, marital status, and identity of children |
| 18 | | under the age of 18. |
| 19 | | "Public official" includes: |
| 20 | | (1) members or former members of the Illinois General |
| 21 | | Assembly; |
| 22 | | (2) constitutional officers or former constitutional |
| 23 | | officers; |
| 24 | | (3) elected or appointed State's Attorneys; |
| 25 | | (4) appointed Public Defenders; and |
| 26 | | (5) county clerks and members of a Board of Election |

| 1 | | Commissioners whose responsibilities include |
| 2 | | administering and overseeing elections; and |
| 3 | | (6) law enforcement officers, as defined under Section |
| 4 | | 5-5 of the Uniform Crime Reporting Act. |
| 5 | | "Publicly available content" means any written, printed, |
| 6 | | or electronic document or record that provides information or |
| 7 | | that serves as a document or record that provides information |
| 8 | | or that serves as a document or record maintained, controlled, |
| 9 | | or in the possession of a governmental agency that may be |
| 10 | | obtained by any person or entity, from the Internet, from the |
| 11 | | governmental agency upon request either free of charge or for |
| 12 | | a fee, or in response to a request under the Freedom of |
| 13 | | Information Act. |
| 14 | | "Publicly post" or "publicly display" means to communicate |
| 15 | | to another or otherwise make available to the public. |
| 16 | | "Written request" means written notice signed by a public |
| 17 | | official or a representative of the public official's office |
| 18 | | or the public official's employer requesting a governmental |
| 19 | | agency, person, business, or association to refrain from |
| 20 | | posting or displaying publicly available content that includes |
| 21 | | the official's personal information. |
