AMENDMENT TO HOUSE BILL 4984

2    AMENDMENT NO. ______. Amend House Bill 4984 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Ticket Sale and Resale Act is amended by
5adding Sections 0.5 and 1.6 as follows:
 
6    (815 ILCS 414/0.5 new)
7    Sec. 0.5. Definitions. As used in this Act:
8    "Reseller" or "ticket reseller" means a person engaged in
9the resale of tickets.
10    "Ticket" means a physical, electronic or other form of a
11certificate, document, voucher, token, or other evidence
12indicating that a person has the right to be admitted to an
13event at a specific time for a specific seat or area.
 
14    (815 ILCS 414/1.6 new)
15    Sec. 1.6. Prohibition on selling tickets not in the

1reseller's possession.
2    (a) A ticket reseller shall not sell or offer to sell a
3ticket that the ticket reseller does not possess or have a
4written, binding contract to purchase at the time of the sale
5or offer for sale.
6    (b) A violation of this Section constitutes an unlawful
7practice under the Consumer Fraud and Deceptive Business
8Practices Act. All remedies, penalties, and authority granted
9to the Attorney General by the Consumer Fraud and Deceptive
10Business Practices Act shall be available to the Attorney
11General for the enforcement of this Section.
 
12    Section 10. The Consumer Fraud and Deceptive Business
13Practices Act is amended by adding Section 2MMMM as follows:
 
14    (815 ILCS 505/2MMMM new)
15    Sec. 2MMMM. Violations of the Ticket Sale and Resale Act.
16Any person who violates Section 1.6 of the Ticket Sale and
17Resale Act commits an unlawful practice within the meaning of
18this Act.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
