AMENDMENT TO HOUSE BILL 4353

2    AMENDMENT NO. ______. Amend House Bill 4353 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Private Detective, Private Alarm, Private
5Security, Fingerprint Vendor, and Locksmith Act of 2004 is
6amended by changing Section 50-10 as follows:
 
7    (225 ILCS 447/50-10)
8    (Section scheduled to be repealed on January 1, 2029)
9    Sec. 50-10. The Private Detective, Private Alarm, Private
10Security, Fingerprint Vendor, and Locksmith Board.
11    (a) The Private Detective, Private Alarm, Private
12Security, Fingerprint Vendor, and Locksmith Board shall
13consist of 11 13 members appointed by the Secretary and
14comprised of 2 licensed private detectives, 3 licensed private
15security contractors, one licensed private detective or
16licensed private security contractor who provides canine odor

1detection services, 2 licensed private alarm contractors, one
2licensed fingerprint vendor, one 2 licensed locksmith
3locksmiths, one public member who is not licensed or
4registered under this Act and who has no connection with a
5business licensed under this Act, and one member representing
6the employees registered under this Act. Each member shall be
7a resident of Illinois. Each licensed member shall have at
8least 3 years' 5 years experience as a licensee in the
9professional area in which the person is licensed and be in
10good standing and actively engaged in that profession. In
11making appointments, the Secretary shall consider the
12recommendations of the professionals and the professional
13organizations representing the licensees. The membership shall
14reasonably reflect the different geographic areas in Illinois.
15    (b) Members shall serve 4-year terms and may serve until
16their successors are appointed. No member shall serve for more
17than 2 successive terms. Appointments to fill vacancies shall
18be made in the same manner as the original appointments for the
19unexpired portion of the vacated term.
20    (c) A member of the Board may be removed for cause. A
21member subject to formal disciplinary proceedings shall
22disqualify oneself from all Board business until the charge is
23resolved. A member also shall disqualify oneself from any
24matter on which the member cannot act objectively.
25    (d) Members shall receive compensation as set by law. Each
26member shall receive reimbursement as set by the Governor's

1Travel Control Board for expenses incurred in carrying out the
2duties as a Board member.
3    (e) A majority of appointed Board members constitutes a
4quorum. A majority vote of the quorum is required for a
5decision.
6    (f) The Board shall elect a chairperson and vice
7chairperson annually.
8    (g) Board members are not liable for their acts,
9omissions, decisions, or other conduct in connection with
10their duties on the Board, except those determined to be
11willful, wanton, or intentional misconduct.
12    (h) The Board may recommend policies, procedures, and
13rules relevant to the administration and enforcement of this
14Act.
