AMENDMENT TO HOUSE BILL 2521

2    AMENDMENT NO. ______. Amend House Bill 2521 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Interscholastic Athletic Organization Act
5is amended by adding Section 1.30 as follows:
 
6    (105 ILCS 25/1.30 new)
7    Sec. 1.30. Licensing of game officials.
8    (a) The Illinois High School Association shall be
9responsible for licensing all game officials as defined in
10subsection (b) of Section 22-80 of the School Code.
11    (b) Each applicant for licensure under this Section is
12required, as a condition of licensure, to authorize a
13fingerprint-based criminal history records check to determine
14if such applicant has been convicted of any disqualifying,
15enumerated criminal or drug offenses as set forth in Section
1621B-80 of the School Code. The applicant shall submit his or

1her fingerprints to the Illinois State Police in an electronic
2format that complies with the form and manner for requesting
3and furnishing criminal history record information prescribed
4by the Illinois State Police. Such fingerprints shall be
5transmitted through a livescan fingerprint vendor licensed by
6the Department of Financial and Professional Regulation. The
7fingerprints submitted under this Section shall be checked
8against the Illinois State Police criminal history databases
9prior to their submission to the Federal Bureau of
10Investigation criminal history record databases, now and
11hereafter filed, including, but not limited to, civil,
12criminal, and latent fingerprint databases. The Illinois State
13Police shall charge applicants a fee for conducting the
14criminal history records check, which shall be deposited into
15the State Police Services Fund and shall not exceed the actual
16cost of the records check. The Illinois State Police shall
17furnish, pursuant to positive identification, records of State
18convictions and shall forward the national criminal history
19record information to the Illinois High School Association.
20Any information obtained by the Illinois High School
21Association may only be disseminated as authorized by law.
22    (c) The Illinois High School Association shall perform a
23check of the Statewide Sex Offender Database and the Statewide
24Murderer and Violent Offender Against Youth Database, as
25authorized by the Sex Offender Community Notification Law and
26the Murderer and Violent Offender Against Youth Community

1Notification Law, for each applicant for licensure under this
2Section. The check of these databases must be conducted by the
3Illinois High School Association's Executive Director or the
4Executive Director's designee once every 5 years that an
5applicant remains licensed by the Illinois High School
6Association.
7    (d) Pending full check clearance under subsections (b) and
8(c), a prospective game official must be supervised at all
9times by an individual who has received full check clearance
10under subsections (b) and (c).".
