AMENDMENT TO HOUSE BILL 1788

2    AMENDMENT NO. ______. Amend House Bill 1788 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Open Space Lands Acquisition and
5Development Act is amended by adding Section 5.5 as follows:
 
6    (525 ILCS 35/5.5 new)
7    Sec. 5.5. Accessibility; universal playgrounds. The
8Department shall, in conjunction with the priorities set forth
9in Section 5, prioritize projects that incorporate
10construction, materials, designs, products, or technologies
11that increase accessibility and usability beyond the highest
12standards established under the federal Americans with
13Disabilities Act (ADA) or federal regulations promulgated
14under that Act. Additionally, in the grant-awarding process
15under this Act, the Department shall give extra consideration
16to projects for playgrounds that use universal design elements

1as part of the design. Projects with a greater number of
2universal design elements shall receive greater consideration
3over projects with fewer universal design elements. The
4Department shall adopt rules to establish the priorities under
5this Section within its grant application review process under
6this Act.
7    In this Section, "universal design elements" includes, but
8is not limited to, the following elements:
9        (1) poured-in-place rubber surfacing or synthetic turf
10    for enhanced mobility and continuously accessible
11    surfacing routes;
12        (2) multiple access points and routes, including
13    additional ramps for seamless entry to play equipment;
14        (3) a variety of ground-level and elevated play
15    components accessible to individuals with diverse
16    abilities;
17        (4) inclusive swings and seating;
18        (5) a variety of single and multi-sensory play
19    elements, such as tactile panels and musical features;
20        (6) shaded areas to accommodate individuals with
21    sensory sensitivities; and
22        (7) any other construction, materials, designs,
23    products, or technologies that increase accessibility and
24    usability beyond the highest standards established under
25    the federal Americans with Disabilities Act (ADA) or
26    federal regulations promulgated under that Act.".
