| 2 | | AMENDMENT NO. ______. Amend House Bill 1788 by replacing |
| 3 | | everything after the enacting clause with the following: |
| 4 | | "Section 5. The Open Space Lands Acquisition and |
| 5 | | Development Act is amended by adding Section 5.5 as follows: |
| 6 | | (525 ILCS 35/5.5 new) |
| 7 | | Sec. 5.5. Accessibility; universal playgrounds. The |
| 8 | | Department shall, in conjunction with the priorities set forth |
| 9 | | in Section 5, prioritize projects that incorporate |
| 10 | | construction, materials, designs, products, or technologies |
| 11 | | that increase accessibility and usability beyond the highest |
| 12 | | standards established under the federal Americans with |
| 13 | | Disabilities Act (ADA) or federal regulations promulgated |
| 14 | | under that Act. Additionally, in the grant-awarding process |
| 15 | | under this Act, the Department shall give extra consideration |
| 16 | | to projects for playgrounds that use universal design elements |

| 1 | | as part of the design. Projects with a greater number of |
| 2 | | universal design elements shall receive greater consideration |
| 3 | | over projects with fewer universal design elements. The |
| 4 | | Department shall adopt rules to establish the priorities under |
| 5 | | this Section within its grant application review process under |
| 6 | | this Act. |
| 7 | | In this Section, "universal design elements" includes, but |
| 8 | | is not limited to, the following elements: |
| 9 | | (1) poured-in-place rubber surfacing or synthetic turf |
| 10 | | for enhanced mobility and continuously accessible |
| 11 | | surfacing routes; |
| 12 | | (2) multiple access points and routes, including |
| 13 | | additional ramps for seamless entry to play equipment; |
| 14 | | (3) a variety of ground-level and elevated play |
| 15 | | components accessible to individuals with diverse |
| 16 | | abilities; |
| 17 | | (4) inclusive swings and seating; |
| 18 | | (5) a variety of single and multi-sensory play |
| 19 | | elements, such as tactile panels and musical features; |
| 20 | | (6) shaded areas to accommodate individuals with |
| 21 | | sensory sensitivities; and |
| 22 | | (7) any other construction, materials, designs, |
| 23 | | products, or technologies that increase accessibility and |
| 24 | | usability beyond the highest standards established under |
| 25 | | the federal Americans with Disabilities Act (ADA) or |
| 26 | | federal regulations promulgated under that Act.". |
