AMENDMENT TO SENATE BILL 1160 




2    AMENDMENT NO. ______. Amend Senate Bill 1160 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Environmental Protection Act is amended  by 
5adding Section 22.23e as follows:
 
6    (415 ILCS 5/22.23e new)
7    Sec. 22.23e. Photovoltaic modules.
8    (a) As used in this Section, "photovoltaic module" means 
9the smallest, nondivisible, environmentally protected assembly 
10of photo voltaic cells or other photovoltaic collector 
11technology, and any ancillary part, intended to generate 
12electrical power under sunlight. "Photovoltaic module" does 
13not include a photovoltaic cell that is part of a consumer 
14electronic device for which it provides electricity needed to 
15make the consumer electronic device function. "Photovoltaic 
16module" includes, but is not limited to, interconnections,

1terminals, and protective devices such as diodes that are:
2        (1) installed on, connected to, or integral to 
3    buildings;
4        (2) used as components of freestanding, off-grid power 
5    generation systems, such as for powering water pumping 
6    stations, electric vehicle charging stations, fencing, 
7    street and signage lights, and other commercial or 
8    agricultural purposes; or
9        (3) part of a system connected to a grid or utility 
10    service.
11    (b) Beginning January 1, 2026, no person may knowingly 
12cause or allow the mixing of a photovoltaic module with 
13municipal waste that is intended for disposal at a landfill.
14    (c) Beginning January 1, 2026, no person may knowingly 
15cause or allow the disposal of a photovoltaic module in a 
16sanitary landfill.".
