| 1 | AMENDMENT TO SENATE BILL 2140

| 2 | AMENDMENT NO. ______. Amend Senate Bill 2140 on page 2, | ||||||
| 3 | directly below line 21, by inserting the following: | ||||||
| 4 | ""Higher education institution" means a public university, | ||||||
| 5 | a public community college, or an independent, not-for-profit | ||||||
| 6 | or for-profit higher education institution located in this | ||||||
| 7 | State."; and | ||||||
| 8 | on page 4, directly below line 12, by inserting the following: | ||||||
| 9 | ""Religious institution" means any church, congregation, | ||||||
| 10 | or society formed for the purposes of religious worship. | ||||||
| 11 | "School district" means any school district established | ||||||
| 12 | under the School Code. | ||||||
| 13 | "Unit of local government" means a county, municipality, | ||||||
| 14 | township, special district, and unit, designated as a unit of | ||||||
| 15 | local government by law, that exercises limited governmental | ||||||
| |||||||
| |||||||
| 1 | powers or powers in respect to limited governmental subjects, | ||||||
| 2 | but does not include school districts."; and | ||||||
| 3 | on page 5, by replacing lines 14 through 23 with the following: | ||||||
| 4 | "Section 20. Safe harbor for compliance with regulations, | ||||||
| 5 | executive orders, or public health guidance. A person, | ||||||
| 6 | business, unit of local government, religious institution, | ||||||
| 7 | higher education institution, or school district in this State | ||||||
| 8 | shall not be held liable for civil damages for any injuries | ||||||
| 9 | sustained from exposure or potential exposure to COVID-19 if | ||||||
| 10 | the act or omission alleged to violate a duty of care was in | ||||||
| 11 | substantial compliance or was consistent with any federal or | ||||||
| 12 | State statute, rule, regulation, order, or public health | ||||||
| 13 | guidance related to COVID-19 that was applicable to the person | ||||||
| 14 | or activity at issue at the time of the alleged exposure or | ||||||
| 15 | potential exposure.".
