AMENDMENT TO HOUSE BILL 245

AMENDMENT NO. ______. Amend House Bill 245 by replacing everything after the enacting clause with the following:

"Section 5. The Alternate Fuels Act is amended by changing Sections 5, 10, and 15 and by adding Section 27 as follows:

Sec. 5. Purpose. The General Assembly declares that it is the public policy of the State to promote and encourage the use of electric alternate fuel in vehicles as a means to improve air quality and reduce the risks from global warming in the State and to meet the requirements of the federal Clean Air Act Amendments of 1990 and the federal Energy Policy Act of 1992. The General Assembly further declares that the State can play a leadership role in the development of vehicles powered by electricity alternate fuels, as well as in the establishment of the necessary charging infrastructure to support this emerging technology.

Sec. 10. Definitions. As used in this Act:

"Agency" means the Environmental Protection Agency.

"Alternate fuel" means electricity, excluding on-board electric generation. liquid petroleum gas, natural gas, E85 blend fuel, fuel composed of a minimum 80% ethanol, 80% bio-based methanol, fuels that are at least 80% derived from biomass, hydrogen fuel, or electricity, excluding on-board electric generation.

"Alternate fuel vehicle" means any vehicle that is operated in Illinois and is capable of using an alternate fuel.

"Biodiesel fuel" means a renewable fuel conforming to the industry standard ASTM-D6751 and registered with the U.S. Environmental Protection Agency.

"Car sharing organization" means an organization whose primary business is a membership-based service that allows members to drive cars by the hour in order to extend the public transit system, reduce personal car ownership, save consumers money, increase the use of alternative transportation, and improve environmental sustainability.

"Conventional", when used to modify the word "vehicle", "engine", or "fuel", means gasoline or diesel or any reformulations of those fuels.

"Covered Area" means the counties of Cook, DuPage, Kane, Lake, McHenry, and Will and those portions of Grundy County and Kendall County that are included in the following ZIP code areas, as designated by the U.S. Postal Service on the effective date of this amendatory Act of 1998: 60416, 60444, 60447, 60450, 60481, 60538, and 60543.

"Director" means the Director of the Environmental Protection Agency.

"Domestic renewable fuel" means a fuel, produced in the United States, composed of a minimum 80% ethanol, 80% bio-based methanol, or 20% biodiesel fuel.

"E85 blend fuel" means fuel that contains 85% ethanol and 15% gasoline.

"Electric vehicle" means a vehicle that is licensed to drive on public roadways, is predominantly powered by, and primarily refueled with, electricity, and does not have restrictions confining it to operate on only certain types of streets or roads.

"Environmental justice community" has the same meaning, based on existing methodologies and findings, used and as may be updated by the Illinois Power Agency and its Program Administrator of the Illinois Solar for All Program.

"GVWR" means Gross Vehicle Weight Rating.

"Location" means (i) a parcel of real property or (ii) multiple, contiguous parcels of real property that are separated by private roadways, public roadways, or private or public rights-of-way and are owned, operated, leased, or under common control of one party.

"Low income" means persons and families whose income does not exceed 80% of area median income, adjusted for family size and revised every 2 years.

"Original equipment manufacturer" or "OEM" means a manufacturer of alternate fuel vehicles or a manufacturer or remanufacturer of alternate fuel engines used in vehicles greater than 8500 pounds GVWR.

"Rental vehicle" means any motor vehicle that is owned or controlled primarily for the purpose of short-term leasing or rental pursuant to a contract.

Sec. 15. Rulemaking. The Agency shall promulgate rules and dedicate sufficient resources to implement the purposes of Section 30 of this Act. Such rules shall be consistent with the provisions of the Clean Air Act Amendments of 1990 and any regulations promulgated pursuant thereto. The Secretary of State may promulgate rules to implement Section 27 Section 35 of this Act. The Department of Commerce and Economic Opportunity may promulgate rules to implement Section 25 of this Act.

Sec. 27. Environmental justice communities; low income rebate.

(a) Beginning January 1, 2022, and continuing as long as funds are available, the Agency shall administer $4,000 rebates to environmental justice community low income residents.

(b) Beginning January 1, 2026, the Agency shall administer $2,000 rebates to environmental justice community low income residents.

(c) Beginning January 1, 2028, the Agency shall administer $1,000 rebates to environmental justice community low income residents.

(d) Rebates administered under this Section shall only be available for new passenger battery electric vehicles at a prerebate cost of $45,000 or less or for used battery electric vehicles at a prerebate cost of $35,000 or less. This cost cut off is exclusive of any electric vehicle-specific rebate offered by any level of government. If the cost of the electric vehicle would be higher than the cost cut off without any electric vehicle-specific rebate, the vehicle is not eligible for a rebate under this Section.

(e) A rebate administered under this Section may be combined with other rebates for eligible vehicles and drivers. The rebate may only be applied one time per Vehicle Identification Number. The rebate may only be used once per person in any 5-year period. To be eligible for the low income rebate, a purchaser must be a resident of Illinois and provide proof of residence at the time of purchase. The State shall direct rebate recipients to local electric utilities where additional charging equipment rebates may be available.

Section 10. The Alternate Fuels Act is amended by repealing Sections 20, 22, 24, 30, 31, 32, and 40.

Section 99. Effective date. This Act takes effect upon becoming law.".
