Amends the Illinois Procurement Code. Provides that each State agency that purchases food through a contract procured in accordance with the Code shall adopt a policy that permits the donation of leftover food purchased with State funds. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Procurement Code is amended by |
| 5 | | changing Section 55-20 as follows: |
| 6 | | (30 ILCS 500/55-20) |
| 7 | | Sec. 55-20. Contracts for food donation; food donation |
| 8 | | policy. |
| 9 | | (a) After the effective date of this amendatory Act of the |
| 10 | | 99th General Assembly, a public entity shall not enter into a |
| 11 | | contract to purchase food with a bidder or offeror if the |
| 12 | | bidder's or offeror's contract terms prohibit the public entity |
| 13 | | from donating food to food banks, including, but not limited |
| 14 | | to, homeless shelters, food pantries, and soup kitchens.

| 15 | | (b) Each State agency that purchases food through a |
| 16 | | contract procured in accordance with entering into or |
| 17 | | maintaining a contract for the purchase of food under this Code |
| 18 | | shall adopt a policy that permits the donation of leftover food |
| 19 | | purchased with procured by State funds. The policy shall |
| 20 | | address any daily food operations run by the agency, including |
| 21 | | one-time events, and shall contain a list of nearby soup |
| 22 | | kitchens, food pantries, and other non-profit organizations |
| 23 | | where leftover food can be donated. Each State agency shall |
