Amends the Food Handling Regulation Enforcement Act. Prohibits a public health district from regulating the preparing and serving of food in a private residential leasehold that is prepared by or for the lessees and consumed by the lessees and their guests.

|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Food Handling Regulation Enforcement Act is |
| 5 | | amended by changing Section 3.7 as follows: |
| 6 | | (410 ILCS 625/3.7) |
| 7 | | Sec. 3.7. Communal kitchen in private residential |
| 8 | | leasehold. |
| 9 | | (a) As used in this Section, "private residential |
| 10 | | leasehold" means a private residential structure not open to |
| 11 | | the public which is leased to more than one person and contains |
| 12 | | a communal kitchen used by the lessees and guests of the |
| 13 | | lessees. |
| 14 | | (b) Notwithstanding any other provision of law, neither the |
| 15 | | Department of Public Health, nor the health department of a |
| 16 | | unit of local government, nor a public health district may |
| 17 | | regulate the preparing and serving of food in a private |
| 18 | | residential leasehold that is prepared by or for the lessees |
| 19 | | and consumed by the lessees and their guests. |
| 20 | | (c) This Section does not apply to regulation of private |
| 21 | | residential leaseholds in municipalities with a population |
| 22 | | greater than 1,000,000.
