AMENDMENT TO SENATE BILL 363

AMENDMENT NO. ______. Amend Senate Bill 363 by replacing everything after the enacting clause with the following:

"Section 5. The Illinois Pension Code is amended by adding Section 1-124 as follows:

(40 ILCS 5/1-124 new)

Sec. 1-124. Participation in a pension fund with respect to private employment. Notwithstanding any other provision of this Code, on and after the effective date of this amendatory Act of the 100th General Assembly, a person shall not be eligible to become a member or participant in any pension fund or retirement system with respect to private employment. A person who first becomes a participant or member of a pension fund or retirement system under any of Articles 2 through 18 of this Code on or after the effective date of this amendatory Act of the 100th General Assembly may not establish service credit in that Article with respect to private employment. "Private employment" includes any employment that is not compensated with funds under the control of a State agency, school district, public institution of higher education, unit of local government, municipal government, or county government or a body politic established under such government and also includes employment by a labor union or an organization representing governments, regardless of whether the organization receives dues from units of government.".
