| 2 | | WHEREAS, In 2011, the Office for Civil Rights under |
| 3 | | President Obama issued guidelines that instructed universities |
| 4 | | that they were obligated to combat sexual assault and |
| 5 | | harassment under Title IX; and
|
| 6 | | WHEREAS, The guidelines also established a requirement |
| 7 | | that college disciplinary proceedings rely on a preponderance |
| 8 | | of evidence when adjudicating cases of sexual assault; and
|
| 9 | | WHEREAS, Recently, Education Secretary Betsy DeVos held |
| 10 | | meetings with a variety of advocacy groups on the topic of |
| 11 | | sexual assault; she also met with sexual assault victims who |
| 12 | | urged her to keep the guidance in place; 20 state attorneys |
| 13 | | general have sent her a letter also urging her to not roll back |
| 14 | | the Obama-era guidelines; and |
| 15 | | WHEREAS, Secretary DeVos has indicated that she felt |
| 16 | | changes are necessary but gave no details regarding any |
| 17 | | specific plans; therefore, be it

| 18 | | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE |
| 19 | | HUNDREDTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we |
| 20 | | urge Education Secretary Betsy DeVos to listen to law |
| 21 | | enforcement and trust sexual assault survivors by keeping these |
