SYNOPSIS AS INTRODUCED:

Amends the Airport Authorities Act. Creates the Central Illinois Regional Airport Authority (within McLean County), the Chicago Rockford International Airport Authority (within Winnebago County), and the Metropolitan Airport Authority of Rock Island County (within Rock Island County). Provides that the Authorities are established 30 days after the appointment of board members to the board of commissioners of each Authority. Provides that any existing airport authority located entirely within those counties is dissolved upon the establishment of each Authority with each Authority assuming the rights to all property, assets, and liabilities of any dissolved authority. Effective immediately.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Airport Authorities Act is amended by changing Section 3 and adding Sections 2.7.3, 2.7.4, and 2.7.5 as follows:

(70 ILCS 5/2.7.3 new)

Sec. 2.7.3. Central Illinois Regional Airport Authority.

(a) The Central Illinois Regional Airport Authority is hereby established, the territory of which shall include all of the territory within the corporate limits of McLean County. Within 30 days after the initial appointments have been made under subsection (c) of this Section, the Authority board shall notify the office of the Secretary of State of the establishment of the Central Illinois Regional Airport Authority and the Secretary of State shall issue a certificate of incorporation to the Authority. Upon the issuance of a certificate of incorporation, the Central Illinois Regional Airport Authority shall be deemed an organized Airport Authority under this Act.

(b) If all of the airport facilities of an existing Airport Authority are situated within McLean County on the effective date of this amendatory Act of the 100th General Assembly, that existing Airport Authority is dissolved upon the establishment of the Central Illinois Regional Airport Authority. In such event, the rights to all property, assets, and liabilities, including bonded indebtedness, of the existing Airport Authority shall be assumed by the Central Illinois Regional Airport Authority.

(c) The Board of Commissioners of the Central Illinois Regional Airport Authority shall consist of 7 commissioners who shall reside within its corporate limits and who shall be appointed as follows:

(1) Three commissioners shall be appointed by the county chairman of McLean County. Of the commissioners appointed under this item, one commissioner shall be appointed for a 3-year term, one commissioner shall be appointed for a 4-year term, and one commissioner shall be appointed for a 5-year term, as determined by lot. Their successors shall be appointed for 5-year terms.

(2) Two commissioners shall be appointed by the mayor of the City of Bloomington. Of the commissioners appointed under this item, one commissioner shall be appointed for a 3-year term and one commissioner shall be appointed for a 4-year term, as determined by lot. Their successors shall be appointed for 5-year terms.

(3) Two commissioners shall be appointed by the mayor of the Town of Normal. Of the commissioners appointed under this item, one commissioner shall be appointed for a 4-year term and one commissioner shall be appointed for a 5-year term, as determined by lot. Their successors shall be appointed for a 5-year term.

Sec. 2.7.4. Chicago Rockford International Airport Authority.

(a) The Chicago Rockford International Airport Authority is hereby established, the territory of which shall include all of the territory within the corporate limits of Winnebago County. Within 30 days after the initial appointments have been made under subsection (c) of this Section, the Authority board shall notify the office of the Secretary of State of the establishment of the Chicago Rockford International Airport Authority and the Secretary of State shall issue a certificate of incorporation to the Authority. Upon the issuance of a certificate of incorporation, the Chicago Rockford International Airport Authority shall be deemed an organized Airport Authority under this Act.

(b) If all of the airport facilities of an existing Airport Authority are situated within Winnebago County on the effective date of this amendatory Act of the 100th General Assembly, that existing Airport Authority is dissolved upon the establishment of the Chicago Rockford International Airport Authority. In such event, the rights to all property, assets, and liabilities, including bonded indebtedness, of the existing Airport Authority shall be assumed by the Chicago Rockford International Airport Authority.

(c) The Board of Commissioners of the Chicago Rockford International Airport Authority shall consist of 7 commissioners who shall reside within its corporate limits and who shall be appointed as follows:

(1) Two commissioners shall be appointed by the mayor of the City of Rockford. Of the commissioners appointed under this item, one commissioner shall be appointed for a 3-year term and one commissioner shall be appointed for a 5-year term, as determined by lot. Their successors shall be appointed for 5-year terms.

(2) Three commissioners shall be appointed by the county chairman of Winnebago County. Of the commissioners appointed under this item, one commissioner shall be appointed for a 3-year term, one commissioner shall be appointed for a 4-year term, and one commissioner shall be appointed for a 5-year term, as determined by lot. Their successors shall be appointed for 5-year terms.

(3) One commissioner shall be appointed by the Mayor of Loves Park. The commissioner appointed under this item shall be appointed to a 4-year term. Successors shall be appointed for 5-year terms.

(4) One commissioner shall be appointed by the Village President of Machesney Park. The commissioner appointed under this item shall be appointed for a 3-year term. Successors shall be appointed for 5-year terms.

Sec. 2.7.5. Metropolitan Airport Authority of Rock Island County.

(a) The Metropolitan Airport Authority of Rock Island County is hereby established, the territory of which shall include all of the territory within the corporate limits of Rock Island County. Within 30 days after the initial appointments have been made in subsection (c) of this Section, the Authority board shall notify the office of the Secretary of State of the establishment of the Metropolitan Airport Authority of Rock Island County and the Secretary of State shall issue a certificate of incorporation to the Authority. Upon the issuance of a certificate of incorporation, the Metropolitan Airport Authority of Rock Island County shall be deemed an organized Airport Authority under this Act.

(b) If all of the airport facilities of an existing Airport Authority are situated within Rock Island County on the effective date of this amendatory Act of the 100th General Assembly, that existing Airport Authority is dissolved upon the establishment of the Metropolitan Airport Authority of Rock Island County. In such event, the rights to all property, assets, and liabilities, including bonded indebtedness, of the existing Airport Authority shall be assumed by the Metropolitan Airport Authority of Rock Island County.

(c) The Board of Commissioners of the Metropolitan Airport Authority of Rock Island County shall consist of 8 commissioners who shall reside within its corporate limits and who shall be appointed as follows:

(1) Three commissioners shall be appointed by the chairman of Rock Island County. Of the commissioners appointed under this item, one commissioner shall be appointed for a 3-year term, 2 commissioners shall be appointed for a 4-year term, and one commissioner shall be appointed for a 5-year term, as determined by lot. Their successors shall be appointed for 5-year terms.

(2) One commissioner shall be appointed by the mayor of the City of Moline. The commissioner appointed under this item shall be appointed for a 1-year term. The successors shall be appointed for 5-year terms.

(3) One commissioner shall be appointed by the mayor of the City of Rock Island. The commissioner appointed under this item shall be appointed for a 3-year term. The successors shall be appointed for 5-year terms.

(4) One commissioner shall be appointed by the mayor of the City of East Moline. The commissioner appointed under this item shall be appointed for a 2-year term. The successors shall be appointed for 5-year terms.

(5) One commissioner shall be appointed by the mayor of the City of Silvis. The commissioner appointed under this item shall be appointed for a 4-year term. The successors shall be appointed for 5-year terms.

(6) One commissioner shall be appointed by the mayor of the Village of Milan. The commissioner appointed under this item shall be appointed for a 2-year term. The successors shall be appointed for 5-year terms.

Sec. 3. Boards of commissioners. Every authority established under this Act shall be governed by a board of commissioners. For authorities other than Metropolitan Airport Authorities, the Greater Metropolitan Airport Authority, the Central Illinois Regional Airport Authority, the Chicago Rockford International Airport Authority, the Metropolitan Airport Authority of Rock Island County, and the Crawford County Airport Authority, in the order finding the results of the election to be favorable to the establishment of the authority, the circuit court shall determine the population of the authority and the population of each municipality within the authority having 5,000 or more inhabitants according to the last census.

Section 99. Effective date. This Act takes effect upon becoming law.
