Amends the Code of Civil Procedure. Provides that a settlement agreement in an action for damages for personal injury based on childhood sexual abuse shall not include the following: (1) a confidentiality provision binding on the person abused; or (2) a non-disparagement provision binding on the person abused. |

| 1 | | AN ACT concerning civil law.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Code of Civil Procedure is amended by adding |
| 5 | | Section 2-2302 as follows: |
| 6 | | (735 ILCS 5/2-2302 new) |
| 7 | | Sec. 2-2302. Settlements in lawsuits involving minors. |
| 8 | | (a) A settlement agreement in an action for damages for |
| 9 | | personal injury based on childhood sexual abuse shall not |
| 10 | | include the following: |
| 11 | | (1) a confidentiality provision binding on the person |
| 12 | | abused; or |
| 13 | | (2) a non-disparagement provision binding on the |
| 14 | | person abused. |
| 15 | | (b) As used in this Section, "childhood sexual abuse" has |
| 16 | | the meaning provided in Section 13-202.2 of this Code.
