Amends the Methamphetamine Control and Community Protection Act. Provides that any person convicted of a second or subsequent offense under the Act shall (rather than may) be sentenced to imprisonment for a term up to twice the maximum term otherwise authorized and fined an amount up to twice that otherwise authorized.

| 1 | | AN ACT concerning criminal law.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Methamphetamine Control and Community |
| 5 | | Protection Act is amended by changing Section 100 as follows: |
| 6 | | (720 ILCS 646/100)
|
| 7 | | Sec. 100. Second or subsequent offenses. |
| 8 | | (a) Any person convicted of a second or subsequent offense |
| 9 | | under this Act shall may be sentenced to imprisonment for a |
| 10 | | term up to twice the maximum term otherwise authorized and , |
| 11 | | fined an amount up to twice that otherwise authorized, or both.

| 12 | | (b) Any penalty imposed for any violation of this Act is in |
| 13 | | addition to, and not in lieu of, any civil or administrative |
| 14 | | penalty or sanction otherwise authorized by this Act or any |
| 15 | | other law.
