Amends the Illinois Vehicle Code. Provides that an owner of an antique moped may register the moped for a fee not to exceed $13 for a 2-year antique plate. Provides that in addition to the appropriate registration or renewal fees, an owner of an antique moped may also register the moped as an expanded-use antique moped for a registration and renewal fee of $45 per year. Defines "antique moped".

| 1 | | AN ACT concerning transportation.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing |
| 5 | | Sections 3-804 and 3-804.01 and by adding Section 1-102.03 as |
| 6 | | follows: |
| 7 | | (625 ILCS 5/1-102.03 new) |
| 8 | | Sec. 1-102.03. Antique moped. A motor-driven cycle, with or |
| 9 | | without optional power derived from manually operated pedals, |
| 10 | | that is more than 25 years of age, or a bona fide replica |
| 11 | | thereof, whose speed attainable in one mile is at least 20 mph |
| 12 | | but not greater than 30 mph, and is equipped with a motor that |
| 13 | | produces 2 brake horsepower or less. If an internal combustion |
| 14 | | engine is used, the displacement shall not exceed 50 cubic |
| 15 | | centimeter displacement and the power drive system shall not |
| 16 | | require the operator to shift gears.

| 18 | | Sec. 3-804. Antique vehicles; antique mopeds.
|
| 19 | | (a) The owner of an antique vehicle or antique moped may |
| 20 | | register such vehicle or moped for a fee not
to exceed $13 for |
| 21 | | a 2-year antique plate. The application for
registration must |
| 22 | | be accompanied by an affirmation of
the owner that such vehicle |

| 1 | | or moped will be driven on the highway only for the purpose
of |
| 2 | | going to and returning from an antique auto show or an |
| 3 | | exhibition, or
for servicing or demonstration and also |
| 4 | | affirming that the mechanical
condition, physical condition, |
| 5 | | brakes, lights, glass and appearance of such
vehicle or moped |
| 6 | | is the same or as safe as originally equipped. The Secretary |
| 7 | | may,
in his discretion prescribe that antique vehicle or |
| 8 | | antique moped plates be issued for a
definite or an indefinite |
| 9 | | term, such term to correspond to the term of
registration |
| 10 | | plates issued generally, as provided in Section 3-414.1. In no
|
| 11 | | event may the registration fee for antique vehicles or antique |
| 12 | | mopeds exceed $6 per
registration year. Any person requesting |
| 13 | | antique plates under this Section
may also apply to have vanity |
| 14 | | or personalized plates as provided under
Section 3-405.1.

| 15 | | (b) Any person who is the registered owner of an antique |
| 16 | | vehicle or antique moped may
display a historical license plate |
| 17 | | from or representing the model year of
the vehicle or moped, |
| 18 | | furnished by such person, in lieu of the current and valid
|
| 19 | | Illinois antique vehicle or antique moped plates issued |
| 20 | | thereto, provided that valid and
current Illinois antique |
| 21 | | vehicle or antique moped plates and registration card issued to
|
| 22 | | such antique vehicle or antique moped are simultaneously |
| 23 | | carried within such vehicle or moped and are
available for |
| 24 | | inspection.

| 2 | | Sec. 3-804.01. Expanded-use antique vehicles and |
| 3 | | expanded-use antique mopeds. |
| 4 | | (a) The owner of a motor vehicle or moped that is more than |
| 5 | | 25 years of age or a bona fide replica
thereof may register the |
| 6 | | vehicle or moped as an expanded-use antique vehicle or |
| 7 | | expanded-use antique moped. In addition to the appropriate |
| 8 | | registration and renewal fees, the fee for expanded-use antique |
| 9 | | vehicle or expanded-use antique moped registration and renewal |
| 10 | | shall be $45 per year. The application for
registration must be |
| 11 | | accompanied by an affirmation of
the owner that: |
| 12 | | (1) from January 1 through March 31 and from November 1 |
| 13 | | through December 31, the vehicle or moped will be driven on |
| 14 | | the highways only for the purpose
of going to and returning |
| 15 | | from an antique auto show or an exhibition, or
for |
| 16 | | servicing or demonstration; and |
| 17 | | (2) the mechanical
condition, physical condition, |
| 18 | | brakes, lights, glass, and appearance of such
vehicle is |
| 19 | | the same or as safe as originally equipped. |
| 20 | | From April 1 through October 31, a vehicle or moped |
| 21 | | registered as an expanded-use antique vehicle or expanded-use |
| 22 | | antique moped may be driven on the highways without being |
| 23 | | subject to the restrictions set forth in subdivision (1). The |
| 24 | | Secretary may prescribe,
in the Secretary's discretion, that |
| 25 | | expanded-use antique vehicle or expanded-use antique moped |
| 26 | | plates be issued for a
definite or an indefinite term, such |

| 1 | | term to correspond to the term of
registration plates issued |
| 2 | | generally, as provided in Section 3-414.1. Any person |
| 3 | | requesting expanded-use antique vehicle or expanded-use |
| 4 | | antique moped plates under this Section
may also apply to have |
| 5 | | vanity or personalized plates as provided under
Section |
| 6 | | 3-405.1. |
| 7 | | (b) Any person who is the registered owner of an |
| 8 | | expanded-use antique vehicle or expanded-use antique moped may
|
| 9 | | display a historical license plate from or representing the |
| 10 | | model year of
the vehicle or moped, furnished by such person, |
| 11 | | in lieu of the current and valid
Illinois expanded-use antique |
| 12 | | vehicle or expanded-use antique moped plates issued thereto, |
| 13 | | provided that the valid and
current Illinois expanded-use |
| 14 | | antique vehicle or expanded-use antique moped plates and |
| 15 | | registration card issued to
the expanded-use antique vehicle or |
| 16 | | expanded-use antique moped are simultaneously carried within |
| 17 | | the vehicle and are
available for inspection. |
| 18 | | (c) The Secretary may credit a pro-rated portion of a fee |
| 19 | | previously paid for an antique vehicle or antique moped |
| 20 | | registration under Section 3-804 to an owner who applies to |
| 21 | | have that vehicle or moped registered as an expanded-use |
| 22 | | antique vehicle or expanded-use antique moped instead of an |
| 23 | | antique vehicle or antique moped.
