| 1 | | AN ACT concerning criminal law.
|
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Criminal Code of 2012 is amended by changing |
| 5 | | Section 24-1.5 as follows:
|
| 6 | | (720 ILCS 5/24-1.5)
|
| 7 | | Sec. 24-1.5. Reckless discharge of a firearm.
|
| 8 | | (a) A person commits reckless discharge of a firearm by |
| 9 | | discharging a
firearm in
a reckless manner which endangers the
|
| 10 | | the bodily safety
of an individual. |
| 11 | | (b) If the conduct described in subsection (a) is committed |
| 12 | | by a passenger
of a moving motor vehicle with the knowledge and |
| 13 | | consent of the driver of the
motor vehicle the driver is |
| 14 | | accountable for such conduct.
|
| 15 | | (c) Reckless discharge of a firearm is a Class 4 felony.
|
| 16 | | (d) This Section does not apply to a peace officer while in |
| 17 | | the performance
of his or her official duties.
