Reinserts the provisions of Senate Amendment No. 1 with the following changes: Further amends the Counties Code. Changes the application of provisions concerning allowing management and mitigation of the effects of urbanization on stormwater drainage in metropolitan counties located in the area served by the Northeastern Illinois Planning Commission to those located in the area served by the Chicago Metropolitan Agency for Planning. Authorizes counties containing all or a part of an urbanized area (currently, only specified counties) to adopt stormwater management plans and any other county by referendum. Provides for drainage districts and soil and water conservation districts to be represented on the stormwater management planning committee in specified counties. Provides that counties' minimum standards for floodplain and stormwater management should have an emphasis on the use of cost-effective solutions to flooding problems. Provides that the stormwater management plans shall evaluate flooding problems caused by urban flooding. Provides that a stormwater management planning committee may make grants to units of local government, not-for-profit organization, and landowners under specified conditions. Provides that a municipality receiving grant moneys must have adopted an ordinance requiring actions consistent with the stormwater management plan. Provides that questions for the levy of an annual tax for stormwater management purposes shall be held at a general election. Defines "urban flooding" as the flooding of public and private land in urban areas that results from stormwater or snowmelt runoff overwhelming the existing drainage infrastructure, unrelated to the overflow of any river or lake, whether or not that land is located in or near a floodplain. Makes similar changes to provisions regarding DuPage and Peoria counties.</SynopsisText><synopsistitle>Senate Floor Amendment No. 4</synopsistitle>
<SynopsisText>Provides that the county board may adopt a schedule of fees as may be reasonable and necessary (rather than as may be necessary) to mitigate the effects of increased stormwater runoff resulting from new development. Provides that, before a county that establishes a stormwater management planning council after submission of the question to the electors of the county may submit a referendum question to the electors of the county for an annual tax, the county shall adopt and enforce a floodplain management ordinance or a stormwater management ordinance that has been approved by the Office of Water Resources of the Department of Natural Resources and designate a Certified Floodplain Manager who has been certified by the Association of State Floodplain Managers (but does not require a county to create a new position or designate another individual if the county already has a Certified Floodplain Manager on staff). Provides that if a county fails to continually meet any of these conditions after approval of a referendum question for an annual tax, the county may not levy the tax until they are in full compliance with these conditions.</SynopsisText></synopsis>
